VERY VERY URGENT!! Gurus PLS HELP

Hi All Gurus,
My brother is here in usa in B1 visa. He has i-94 valid until spet 10, 2004. One company offered him a job and willing to sponsor for H1b from oct01. He got the graduation from CANADA. Hes doesnot have Canadian PR.
My question are as follows:
1. Can he change his status B1 to H1b . He has valid I-94 up to sept 10. whereas the H1b starts at oct 01.(20 days gap)
2. What should he do? Apply for new H1b and go to canada ? or Home country to get H1b visa.whichone will be applicable for him?

Please help me . I will be grateful to you guys.

Similar case..

One of my friend's situation was similar.
He came from India on B1(Company A) and his H1 was filed by another company(Company B).He left company A and joined Company B after his H1B was approved.
After working for some days ..he has to get his visa stamped .He went to Mexico for stamping and his visa was rejected.

As far u r brother's case is concerned.he will be out of status if he is in USA,because of that 20 days gap..
I would suggest is go outside USA and get it stamped and come back after Oct 01st.

by this time, can he work voluntarily? he wont take any payment!!
------NO, he will be doing a job that can be done by US citizen or others legaly authorized to work, if he works it will create problems for him in future
