My company is saying ther are not going apply for the EAD. They are not offering any reason why...The company is sending the I-485 docs for AOS. Here are my details:

1. H1 Expiring in March 2002. Extension approved for 1 year.

Here\'s my question:
1. After 6 months if I am laid off, can I gain another employment without the EAD.
2. Can I file for the EAD on my own...Will I have a problem with the INS...

Folks any info would be immensely appreciated...

Correct Answer for Q1

1.You can do a H1 transfer. I am assuming that your company will apply for h1 extension instead of EAD, becuase you need a valid employment authorization even under AOS to work, either a valid H1 or EAD. All you need (after 6 months) is that you join a company which offers similar job responsibilities, title and salary (in that order of importance). GC is for the future job.

2. Best option. Wait for I485 receipt (ask your employer/lawyer to send a copy for proof of adjustment status) and then apply on your own. See my previous posts on the details of EAD application requirements.
