Very Urgent - EAD Expiring

I am in very bad shape. My EAD is expiring in one month and I have not filed renewel, I noticed only today. I dont think my ead will get approved even if I apply now.

What should I do. Please please help me. I dont have autorney. I came out of my previous employer and didnt hire any lawyer.

Is I765 elligble for premium processing. I come under c9 - I485 employment based ead.

You cannot work if you are not getting your EAD before your EAD exprires. But you will be still in status(pending Adjustment)

Getmeone, Do not waste your time and apply for a renewal asap. There is a chance that your EAD may get approved in 30 days based on recent renewal approval trend. Few people in this forum may suggest you to continue working even after ead expiry as you will be covered under 245(k). My sincere advice to you is do not take any chances and stop working after your ead expiry as 245(k) is not clear on covering a person who already applied 485. I am not trying to scare you my friend but it is my personal advise to you after reading tons of posts and spent enormous amount of my time. Here's what you can try

*** Apply EAD renewal asap
1. After you get the receipt, take an infopass appt at local asc and show them a letter from your employer stating that you will be fired if you do not get an interim EAD (i think interim eads will now be issued from centralized location but local asc will accept them for processing. what this means is you will not get interim EAD on the same day as it used to be prior Oct 1, 2006)
2. If you were denied an interim EAD, stop working after expiry of EAD and wait for your new ead before you start working. You are eligible to stay in US even if you do not have EAD as long as your 485 is still pending.
 
somebody said - that - it's just a proposal and not yet implemented....

only the I-140 Premium processing got implemented

i765 is eligible for premium processing, but uscis has not decided when to begin and end the premium processing.

So I dont have any choice other than not working till i get the ead. If I dont work, am I still maintaiing my legal status ? reason Im asking is shouldnt I be employed all the time till I get my gc?

should i go for efiling or paper filing. How long does it take for the uscis to send the appointment for biometric. Or should I call them to make an appointment.

We (my wife and I) had the same problem like you. Once we told our HR (we worked in different companies) about our expired EADs, the HR informed us to stop working until we got our EADs. We took leave without pay for more than 2 months (vacation in pain). We lost a lot of money. The USCIS just made fun of us. They approved our EADs after pending for 89 days. There is nothing we can do...just apply ASAP !
 
As a primary applicant, is it legal to stay in the USA with I485 pending and no EAD(ead has been applied no approval yet) and no valid H1 ?

Yes you can stay in US,while your I-485 pending and without EAD(BUT CANNOT WORK)

Just got an email from my attorney the there in no premium processing for EAD. I am really sorry for giving you guys some confusing news. Now I am also in very right situation so not sure where it will go. But I just checked the new website.. Here are the details.. Not sure whether this info is there on the site from long time or not.. Again my apologies to Getmeone for providing some confusing information.. Sit tight at watch.. that is what we can do now..
