validity of OPT upon H1B approval....

Hi All,

First of all my sincere thanks to Jaxen & nkm-Oct23 for their reply for my previous posting.

Now I have another question..., my brother is currently on OPT till the end of July, 2004. A university is offering him a job from August, 2004 and they are planning to start his H1B1 visa processing in this June. Till then he has an offer to teach in another college for 2 months starting from June 1st week. So, can he work on this 2 months teaching with his OPT while he is waiting to get his H1B approval. What happens if he gets his H1B visa approved in the middle of his 2 month job, does his OPT gets voided and he has to stop his 2-month job in the middle even though the start date on his approved H1B visa is going to be from August 1, 2004.
In other words, is his OPT going to be valid till the start date on his H1B approval or is it going to be voided as soon as his H1B gets approved though his H1B visa start date is August???

H1 start date will determine OPT validity date. Since any new visa will start from Oct 2004, your brother can work using OPT till then.
