Employer Re Filing 140 with Labor substitute and linking with denied 140 file.
Immigration Representative told me that there may not be a need to file 485 again.

Is Denied I485 legal?
How old denied 485/765 become active??
Is it possiable to link with file?
Any one come accross this situation/case?

Any ideas.... please let me know.

sorry to hear about. it seems I-140 made cause of everything.

Hey remember noone is perfect, and none of the here case is 100% perfect. the officer has nothing to do anyone personal they just follow law and documents of evidence.

So hang it there with us, and please don't be disappointed, just relax don't panic , beleive on your luck and try again to submit your case (we pray for ur good luck)

it seems that there would be small issue ... that wasn't resolved.

I believe you may have chance to appeal. ... but before make any decission. find out the the actual cause of it.

what labour certificate exactly says about position and responsibilites?
did u receive any RFE????? if then what kind?
what kind of company is it..
do yo have good relation with Boss...?


First find the reason. why? then get a good attorney, and Always read your pettition applicaiton and get copy and receipts with u.

the case seems okay to me.

but let me ask you.... do you know why the I-140 denied?
Ask to attorney and get the copy. is it company lawer? or ur own. and second did u have I-140 and labour certificate pettions copy with u?.

seems ur company is in good financial condition.


then what went wrong is that from ur document side or is that company side????

you have to findout exactly reason.

It seems thats some kind of mistake.... otherwise they would be issuing RFE. or may be RFE issued and didn't reached to you.

Please find out the reason first before u resubmit ur pettition.

What I suspect is that if his LC was approved then there is some mistake on part of lawyer in LC filling and I-140 filing and at the time of I-140 approval the BCIS found that mistake. If the education or EXP and education evaluation were used for LC then the BCIS officer found something wrong and sent the RFE and lawyer could NOT satisfy the BCIS officer with the evidence. If the evidence was enough to approve your I-140 why the BCIS deny the I-140. I suspect some more stories linked to that LC and I-140. Normally the BCIS does not send direct denial, first the issue RFE. I hope you were not eligible for that I-140 or lawyer may have ticked wrong base of I-140. Denial is based on what? What the BCIS wrote in denial letter?
 
I Agree with you Ginu....

One of case I know had same issue.... RFE issued.... and I believe most case ... RFE is issueed.......

Lets wait what A0001 finds about it.
