Hi,
I have question about the validation of current TN status once you got issued new TN for new employer.
Can you answer the following.
1. I got issued new TN visa for new employer recently on March-06-2025 and at the border crossing why need a new TN while having valid TN so I stated changing employer but the end client is same and will leave the job with current employer to start with new employer (consulting firm) but for the same client. Upon serving notice period to current employer and they got knows who is the new employer and my job position but restricted me to join stated can’t work for the same client due to non-compete agreement in place. Advised me to continue working with them or change the client & location if wish to join new employer. The current employer legal team advised I am ok to continue working on previous TN status that’s still valid until Sep-02-2026.
2. So in this situation is it ok to continue working with old employer on previous TN status since I didn’t join the new employer due to being not in violation of non-compete contract clause.
3. Or should I have to get new job letter to apply for new TN to continue working with old employer.
I know this being a tricky situation and bit long explanation any advise would be greatly appreciated.
