Valid Stamped H1B and I-94 Expired

Hi All,

Kindly advice me on the following Issue.

I have Valid Stamped H1B till June 2007. But at the port of entry i was given I94 till Oct 2005. So i have applied for H1B Visa extension. And i have received a new petition receipt Number. I did'nt get the approval yet, waiting on that and also for the new I94.

My Question is whether i can leave the Country before i get my I94 from the new approval.

2. or if i leave US do i need to have Stamping again in my Home country for this.


Kindly Advice me...

Yes. I totally agree. one shouldn't travel while in COS. mvk123:- you should either expediate your transfer using premium processing or wait until it's approved.
 
Thanks for your response. But i still have some queries

1. In case my petition is appoved before my travel, will i be able to leave and enter US without any issues.

2. I have Stamped H1B Valid till June 2007. And do i need a Stamping while entering US again on the new Petition.

Here also no issue. since you have valid stamp until June '07. you are fine coming back, show them new approval and I-94 attached with it.
