valid i-94 but under removal

My H1 is valid and i-94 until july 2011.
my i-140 is denied and appealed for 290b and that is still pending since jan 2010.
i got two approvals from INS after this with valid i-94

i got a letter to appreat before the immigration judege that i am staying here out of the time from jan 2010 and the letter says that i am in removal procedings.

will they take me into custody when i attend the immigarion court ?
i want to go back to india after this hearing even it is positive or nagative

please advise me.

can you explain me little bit on your friends case.

i have valid h1 and i-94 and pending 290 B.

What are the charges on the NTA?
 
the charge is that i am overstayed for more than one year. according to them my last date is jan 22,2010. and they said that i am overstayed one year now. i have valid i-94, but my employer revoked my 1-140 and i think it will also cancel my 290B. but my new h1 transfer approved on december 1, 2010. please reply sir

You need to consult a lawyer that specializes in removal proceedings.
The sooner the better for you.
