can i use copies of indian passport + US driving license + score report from school in india showing birth date + school certificate from india showing birth date instead of birth certificate ?

to my knowledge, you can't use any other document than Birth certificate issued by local administration in India.

Since I had lost my birth certificate and I couldn't get one from COP, I used a notorized letter of affidavit of birth record from 3 relatives (one being my mom) justifying my birtn information. My case is still pending so I am not sure what they will say about that to me, but I know several people who did that and got approved without a problem. If you want, send me a PM and I will send you a copy of the letter format. I used the same one as those people who got approved.

If you do not have birth certificate, you should do following (This is the only alternative):

1. Take the "No Record available certificate" from local authority (who issue birth certificate) of your born city. It should be on letter head off local government authority with seal and signature of officer. You can find the format in any appropriate thread.

2. Take the affidavite of your father and modher (both). In absence of parent, you can take affidaviate of two different person, who are atleast 10 year older than you and can witness your birth date, parents name, and birth place.

If documents are not in english, translate it with notary or authorized agency.

What if you are an asylee and you do not have any contact with the local authority (COP) and you can't get the "No Record available certificate"? In my case, the local government would not recognize me or provide any services for me. I am sure there are other people in the same boat. Would the affidavit of the 3 people not be enough?

This is a very good question. I am not sure about asylee. You can take advise of expert. As a general rule, USCIS consider "No Record available certificate" + Two affidavit.

Thanks Raj. Yes, the person I know who used affidavit of birth record from 3 relatives was directed by her lawyer to do so, telling her it was acceptable. Because she got the information from a lawyer, I (and other relatives/friends)did the same thing she did assuming what was good for her, is good for us. Now my case has not approved yet, so I can't say it has worked for me, but I know it has worked for her (her GC was approved last year without INS asking her to submit any other documentation regarding her birth record.)

Maybe it works for asylum cases since INS knows that it will be hard to produce documents from COP, but it might not work for other people who have cases other than an asylum case.

I have a question regarding submitting Birth Certificate for 485. I currently have only a photocopy of it. Does it suffice or do I need the original to submit to INS? Please advise.
