Using Advance Parole - After 6 Months Staying outside USA

Hello,

My wife is has Advance Parole valid until July, 2006.

Can she stay in India for more than 6 months and use the AP on arriving to US.?

Sure, so long as the AP hasn't expired.

6 months from today is september 2006. so if her ap expires in july 2006 when she is out of the US, she cannot re-enter on an expired AP. Also a person has to be physically present in the US at the time of AP approval if you plan to use that AP to re-enter the US. hope that helps.

Here is more details.

My wife left US on Oct, 2005. She want to come back to US in June 2006 (After 8 Months). The AP is valid until July 2006.

your wife should not have any problems upon rentry to the US.

She will have no problems with renentry using AP; but husband and wife staying apart for several months, might lead to additional scrutiny during adjudication, so be prepared with enough documented evidence of relationship like joint insurance, lease/mortage, utility bills etc.
