Hi,
I have an H1 approval but did not get it stamped.
My current H1 expired in May.
I had to go to India for an emergency and had to come back on AP.
What is my status now. Do I still have H1 status ?
I have an EAD. Can I still get H1 stamped ?.
Should I have to inform my employer that I used AP and that they have to treat me as being on EAD.
I never used my EAD.

Thanks for you help

Sri

Thanks ginnu!.

So I can maintain my H1 status. But can I get my passport stamped by sending to St Louis, or should I have to get it done at a US embassy outside the country.

Thanks

Sri

you can send it to state department for revalidation if your current visa stamp is about to expire in next 60 days or already expired and is within 1 year of expiration date.

On a similar note I have another question.

When I used AP, one copy of it was taken at the port of entry and the other stamped and given back to me.
How many times can I use an AP to enter US ?.

Are there any drawbacks to using a single AP multiple times ?

did they take your original AP???
I think the original AP is valid for multiple entry. How many original copies of AP does one get?

You have other two original copies with you. You can use other original copy to enter US before it expires. If you have to visit after 4-5 months better apply for new AP and receive it in hand before departure from US as BCIS takes time to issue AP. It is always better to keep valid AP with more validity date. No need of lawyer you can file it yourself.

my lawyer only sent me one copy and said they do not take anything at the POE -- just take a look at the original and let you in.
