There seems to be a convention that you have to stick with the employer for at least 6 months after you get your green card. Is the same concept applicable to persons who used AC21 and get the green card. Do they have to stick with the AC21 employer for 6 months?
Any opinions?

Ginnu,
I have two questions for you:
1. Do you know what's EVL, either 485 RFE or AC21 RFE related to employment verification letter. Is it more like an offer letter, like "we are willing to pay what to hire XXX sometime later", or just proof of your current employement, like "this is to verify that XXXX has worked here since when with what salary.

2. Have you heard of any AC21 RFE related to your petition employer/GC sponsor?

Thank you in advance!

----------------EVL: employment verification letter
I-485 RFE: Request for further Evidence
AC21 RFE: Request for further evidence for AC21

To use AC21 search the threads for sample AC21 letter it has been posted may times. You need to do some work or go to your lawyer

2. Have you heard of any AC21 RFE related to your petition employer/GC sponsor?
---------- I have read not 'heard' .
your petition employer/GC sponsor?
--------- how did you presume I have my petition pending or I have GC or I have citizenship pending?

Thank you in advance!

Hi Ginnu,
Thank you very much for your promp response.

I didn't put my question clearly enough first time. Now I'm trying to express better:

1. Is EVL more like an "offer letter"---to say the company is willing to pay you how much for a future position-------or, is EVL more like a "proof"?-----to say the company is to verify you have been working here for how long with what salary, like what they write for me when I invite my parents so my parents could show the letter to Embassy.

I thought 485 RFE for EVL is a "proof", until I saw someone was using "offer letter". Which one do you think is better?

2. If one has AC21 RFE when one's case is adjudicated, could this AC21 RFE require one's GC sponsor company to answer?

I assume AC21 RFE is only related to the company one moved to, not GC sponsor company. If they issue RFE which needs to be answered by one's previous company, there is big risk there if the GC sponsor said this employee is not working for us anymore. I never read that AC21 has this kind of risk.

Sorry for the misunderstanding first time. I appreciate your time and help.

-------------------AC21 job offer letter has date of your joining, your job duties, your salary and permanent job offer after I-485 approval, it has nothing to do for your parents Visa

------------if AC21 is invoked USCIS can ask new employer ability to pay

-correct

Thank you for your answer.

It's good to know that AC21 RFE for Employment Verification Letter is like a "offer letter", instead of "Proof" letter.
