How long does it take for the status to be updated after the RFE response is sent. My lawyer claims the RFE2 reply was mailed thursday night but the status hasn't changed yet. But for RFE1 the status changed in 1 day.

Any ideas ?

RD 7/02
ND 7/02
RFE1 6/04 (Proof Of Status)
RFE2 8/04 (EVL)

Do you have any idea why you did not get these two RFEs at the same time? One would think that if they open the file, they will ask for everything that is missing or needs to be revalidated.

Guys, Is this common?

Thanks,
Mugdha.

skumar2003,

Ask your attorney to send you a copy of the replied RFE with cover letter, it should tell you when they send it out.

I am not trusting my attorney's promises, everytime he said he was going to do it for me second day, he never kept his promises. I believe it till I saw it.

This is only my opinion to my attorney.

Depends on the person looking at the case

That is what is expected. Whoever looked at the case should have asked for all the information in one shot.. But that is what a intelligent person would do..

I am stuck between this fellow on one end and company lawyer (worse!)
on the other end. GOD ONLY CAN SAME ME!

RD July 2002
FP2 April 2004
RFE June 2004
RFE Received June 2004
After that there has been complete silence on the part of NCS I tried to call them and told other people are getting approved they said we are processing Feb 2002 and they process applications on Case by Case basis.

I want to find out what is going on there does anybody know any procedure to do that.

Did you get FP2 done ?

Mugdha2100/nsc_july02,

Too bad that they have not approved even 2-3 months after receiving the RFE reply. I am just thinking if a FP2 notice is on the way..Or if it is stuck up at the FBI Name check.

In my case..Agreed a moron issued the RFE2 again..but atleast he did it quickly.. my company lawyer took months to Reply.

Also I checked with my company lawyer and infact the RFE was replied
on thursday night.

Out of past experience my company lawyer delays/does not reply/is slow
but does not LIE or MISGUIDE.

Let's see.

Nobody knows how they are processing our cases.

They issued RFE (EVL) on my case on May 7, and received my attorney's reply on May 27, after that no news/progress in almost three months. So I called senator's office, they sent enquire to NSC for me, NSC responded to us saying my fp expired and they would schedule an appointment for me very soon, that's May 24. I got fp2 notice on May 30 (only for me, not for my wife), the scheduled time was September 8, after that no further news except LUD changed on September 10, 13.

It's really frustrating, I contacted senator's office again, they called NSC for me, and was told I had to wait at least 10 business days. Let's see what could happen.

AD 12/04/2004 (I-140)
ND 12/20/2002 (EB2 I-485)
FP1 2/1/2003
RFE 5/27/2004 (EVL)
FP2 9/8/2004
LUD 9/13/2004
AD ??????

peterwang60,
when you dealt with senator's office, how long does it take them to call NSC and get back to you? Do they call the same day, and wait for an answer ... what exactly is the procedure. I've a friend of mine deal with her case with a senator, and it took about 3 months for a responce as she didn't know where the hold up was (senator's office or NSC).

npnjan02,

Everytime I contact (email) to Senator's office, I got response from Senator's office in the same day, they either tell me that they are going to send enquire or call NSC, I was told they usually got feedback from NSC in 10 business day, so we have to wait 10 business days.

The Senator's office that I am contacting is in the same region where I live in. They are very friendly. Like what I said after replying RFE, I waited almost 3 month, no news from NSC, I called Senator's office, explained to the person who is in charge of this kind of issues, she followed my case with NSC, then I got fp2 notice. Now my fp result is sitting in NSC, no further news, so I sent her email again, she replied me right way and told me that she called NSC and just found out the process and how the docs were updated over there, she wanted me to wait a few more days, and she would contact congressional contact this Friday if no news on my case, because my fingerprint result was received by NSC on September 10, we should give NSC 10 business days to process it.

Hope this information could give you some help.

peterwang60, thanks for your detailed info.
I guess things have changed since my friend's case and her delaied responces from senators office. I am myself hesitant to deal with senators etc, since I believe poking my case could generate RFE thus further delay. Now I am hoping for a "silent" approval.

Almost forgot to ask - does your LUD change every time they look ar your case either because of the senator's call or inquiry?

npnjan02,

LUD changed when replied RFE, fp2 result were received by NSC. The latest change happened on September 13, don't know the reason, it was changed on September 10, because first they received fp2, then they replied my inquire asking for correct my SS number in their system, I received the letter on Monday.

I don't know if Senator's call could keep LUD changing.

I got RFE, FP1, FP2, it should be all they need so far, couldn't figure out the reason to drag them to approve our cases.

My case is pretty standard, EB2-RIR, no company/job/location changed since day1. I know a lot of people who filed application before me haven't gotten approval yet, I just couldn't wait as some other people filed their application after me got approval. I want to find it out what stuck our cases.
Don't want to wait.

As per my company lawyer..

As per my company lawyer this (lack of status update) is a frequent problem.
She positively replied to the RFE on 16'th evening. I thought atleast
for RFE response the status gets updated. But I've been proved wrong.

What surprises me is even the LUD did not change!
I hope atleast at final stage (after decision) the online status is updated.

bye
