04/10/2008: USCIS Proposes to Change TN Period From One-Year to Three-Year

USCIS intends to change the Canadian TN period from the current one-year period to three-year period. This plan will take time as it will have to amend the current TN regulation. The USCIS has just initiated the process by submitting the proposed rule to the OMB yesterday for its review and approval. Since the clearance will take from 30 days to 90 days, the proposed rule may not be published for the comment by the public for a while. After the comment period is over, the agency is likely to draft and go through the final rule making process. This plan is a part of Bush's administrative fix of immigration initiatives which was released by the White House last year. I'm not holding my breath this change was announced last year 6 + months later they've just submitted for review and approval. Maybe in 2009 but I wouldn't bet a nickel on it.
 
OMB cleared the proposed rule today, so there's some progress. There'll be a period for comments, drafting of a final/interim rule, another 2-week OMB review and then publication in the Federal Register. We're still a ways away, but perhaps by end of year.

I think there's going to be a push to get this done before the current Administration leaves office.
