USA GC pending - Got CANADA IMMI. Visa Stamped in PP.

IF NOT ALL THE QUESTIONS, PLEASE REPLY TO THOSE FOR WHICH YOU KNOW THE ANSWERS OR HAVE IDEA FOR. THANK YOU.

I'm working in USA on H1-B visa and my green card is being processed thru' my employer.
I had filed my I-140 and I-485 concurrently about 6 months ago. I have gotten my EAD card but I'm not using it and 'am still on H1-B visa.
In the past, I had filed for Canadian Permanent residence also. I got my Canadian Immigrant Visa stamped on my passport.

These are my questions if I visit Canada:

1) How will I get the Canadian PR card as I'm not aware of the whole steps/procedure involved?

2) What's the best way to go to Toronto for entering on first time on immigranvt visa ---Flight/ Car?

3) Can I come back the very next day? If so, will I be asked any questions by the Canadian Border/Immigrant officer while leaving the country.

4)Do I need to provide a mailing address in Canada to receive the PR?

5) Will I be asked any question by US Immigrant officer while entering US such as purpose to visit Canada? What should I answer them?

6) Do I need to apply for Health card/medical insurance in Canada as I read in one of the postings but it was not clear.

7) If I do so, will it affect my current Green Card processing in USA in any way?

8) Also, will it create any problem while entering USA after visiting India or any other country on vacation while still on H1B with Canada Immigration visa Stamped on my passport?

Yes, they can ask about the purpose of visit for security reasons. Tell him the truth.

No, it does not. Because you haven't received your US GC yet. After you receive US GC, you need to decide which one you want to give up - US GC or Canadian PR. Until that time, you can keep your Canadian PR.

No. It does not.
 
2. I'm a Canadian citizen. I've found border crossings to be easier when driving. (I always cross at the Peace Bridge in Buffalo/Fort Erie).
3. When you leave (by car), you aren't stopped on the Canadian side (at least not at the Peace Bridge). All of your questions come from the US customs on the US side.

It won't affect your gc process. US immigration don't care about your canadian stamp or your status that you are Canadian resident when you enter USA so neither do Canadian immigration about your us gc process when you enter Canada. or any immigration of any country don't care about your status.

But when you get your U.S. gc, you must decide to give up one: Canadian PR or US PR. You cannot use both.

Go ahead to drive by car (best way). Also, Go ahead to apply for Canadian Health card and other benefits like social security card.

I think we can keep both Canadian PR and US GC. You are considered being physically present in Canada for PR and citizenship eligibility purpose in following scenario even if you are not physically present in canada.

1.You are out of Canada but your spouse is living in Canada. So you can work in USA on a consulting kind of job and travel to canada every weekend and hence maitain both PRs.
2. You are employed by a Canadian business but sent to work in USA.

The very meaning PR status is that you have to live in a place permanently. And you cannot live in two places permanently at the same time. No matter how many times you travel to Canada and how many days you work/live in USA - eventually you have to decide which one you want to consider as your "paremanent residence" - US or Canada. If you consider Canada as your perm residence, then give up US PR status and work in US on working visa - H1 or L1 (and travel to Canada every weekend). And if you want to keep US PR status, you need to give up Canadian PR and visit Canada as "visitor" (not as Canadian PR).

PR status has nothing to do with employment or employer. It totally depends on where you live. If you live in US, then you ar US PR. If you live in Canada, you are Canadian PR. Employer's location/address does not matter.

----- he cannot apply for health card in Ontario, he need to wait 3 months after landing and proof of canada stay like Canada DL , SIN card, Utility bills and recent Canada Bank account statements.
and other benefits like social security card
---Canada does not have social security card, they have SIN card and to apply SIN one needs to visit HRDC office fill up the application and SIN card will be sent to Canada address.

According to the Canadian Immigration and Refugee Protection Act (IRPA), an incompliance with "3 year out 5 residency test"' creates a presumption that Canadian PR abandoned his/her status , therefore , this rule does not automatically revoke one's residency. Only an active action by the Canadian Immigration authorities .

The rules and regulation on IPRA also provide with an additional flexibility to accumulate residency days for Canada. Specifically, if you are outside Canada for extended periods of time, you can still accumulate residency days in the following case
-accompanying a Canadian spouse or common-law partner, or are a child accompanying a parent;
-employed on a full-time basis by a Canadian business or the Public Service of Canada; or
-the accompanying spouse, common-law partner or child of a permanent resident who is outside Canada and who is employed on a full-time basis by a Canadian business or the Public Service of Canada.
 
I'm not interested in settling in Canada .It's just for the backup.
I'm interested in knowing answer to below 2 questions:

1) How will I get the Canadian PR card as I'm not aware of the whole steps/procedure involved?

3) Can I come back the very next day? If so, will I be asked any questions by the Canadian Border/Immigrant officer while leaving the country.

In same boat

To best of my knowledge, you can come back the very next day. To presevre your Canadian PR, you have to stay there for 2 years in 5 years. So you can go there after 3 years and stay for 2 years. If not, your PR will be cancelled. So you can have the Canada backup only for 3 years.
 
To make things clear, here are my comments and my experience.
I got US GC stamped in my passport first and then after a week I landed in Canada as Permanent resident.
The Canadian authorities seen my US GC stamping in the passport and even thought they issued me the PR status in Canada.
The lady clearly told me since you have PR status in both countries, we will monitor you and you got 3 years of time to decide which one you have to keep?
so till 3 years you can have PR status in both countries. According to Canadian policy, if you are out for more than 3 years in every 5 years, then your PR status in Canada will be cancelled.
so till that time you can use Canada PR to enter Canada and US PR when coming back to US.
It won't create any problems.
Canda dont wont to lose new immigrants, so they giving 3 years of time to decide for you if you can come back to Canada.

----Just give any of your friends or relatives address in Canada the time you land and they will send the card thru mail within 5 weeks.

3) Can I come back the very next day? If so, will I be asked any questions by the Canadian Border/Immigrant officer while leaving the country.
-----yes. you can come back the same day. no problem.Only US official will ask about your status. you can always tell you visited Canada for landing and coming back to US for work since you have a valid status in US and a job here. you will be all set. if you have a valid status in US, they will always allow you to enter US and they dont care if you have 1 PR status or 10 PR status with other countries around the world.

--- becase Canada Immigration lied to you when you applied for Canada PR and you were assessed accrding to point system with education and Experience and they dont have job for you in Canada, they want who can do labor jobs but wanted Master degree holders. so they give you 3 years or if you lie at border that you left 2 days back they dont care becase they dont have any exit record by air or border. if you wish apply Canada citizenship after 3 years, what maximum they can do is deny the application. Canada immigration is a big scam, they earn Intrest on your fees for 2-3 years as most of the cases from India are taking 3-4 years. how many have been denied PR status of Canada if one stayed more than 3 years out and walked to Canada throgh Rainbow bridge in Naigra falls and said that he went to meet a friend 2 days back to US and returning HOME??? I have read 5 cases those who never stayed in Canada lied on Canada Citizen applications and got Canada citizenship. CIS lied that Canada has jobs and they lied on applications, nothing wrong . FYI the CIC is being sued by many lawyers and Class law suit has been filed again minister of Canada immigration and CIC read "The Rasolzadeh Class Action " or search for it
