Us Marriage - Green Card

Hello everyone,


My issue is so simple but everything else in INS forms and websites is so complicated. It is very frustrating.

I am married to US citizen in Florida and after that I had to travel back to Montenegro/Eastern Europe because I graduated from college in USA and I needed to see my family.

She then started to work in New York. We never finished any paperwork. Well only paper we got is the marrtiage certificate.

My student visa is over and now I need to apply for new visa. I also need to apply for green card. But WHOLE process is extremely frustrating and I dont want to make any mistakes.


Can anyone guide me how to and which forms I need to fill and as I said I am still in europe and we never did any paper work.

I am planning to go to US in September please help me.

As the spouse of a US Citizen, I believe your wife will need to file an I-130 on your behalf. When she gets the receipt, she needs to file an I-129F to get you a K-3 visa. You can then come to the US, and file the I-485, I-131 and I-765.

I don't know much abt this situation but i think if u r married to a US citizen and then left the country without paperwork , u can jeopardize ur re-entry.
It would be better if u can ask this from a immigration lawyer.

Huh does anyone know more about this issue?

I really don't have money for lawyers.

I know that information is there somewhere BUT WHERE?

Ignore bhappy22, and read my posting again. That is all you need to do.
 
It is not so complicated if you print all the documents and forms and read carefully and find out that is well describe. If you still have questions about it is better to go to the the main source (USCIS). In this case your wife should make an InfoPass or get all the information for you, since she is a US citizen, is in the US and will have to make the petition for you.

So far, you will have to wait (in your country) while she is making all the process. Is frustrated but that's the rules of the game.
Unfortunately you could stay while you were in the states (after got married not leaving the country) and make all the adjustment of status and even ask to advance parole so you could visit your family. But that is past. You can't do that now.

Is the same process that theRealCanadian told you. Over the USCIS you and your wife can download the files and know wich documents will need.

My wife contacted lawyer and this is what he told her nad then she emailed it to me:

"We could fill out that
fiance thing you were talking about but that only gives us 5-6 months
sooner. And then it is harder to do the paper work. The lawyer says we
need to file an I-130 , a money order of 185. a G-325-A (all four
forms) filled out, one for me and one for you. a copy of my birth
certificate, a copy of our marriage license, one color photo pass port
sizes and style of you and one of me. then we send that in. Wait for
4-5 weeks for reciept. Then fill out that next set of paper work. Whci
I haven't even got into yet. But the main thing is that you can not
come her till we get all this done."


She said it will take 6-12 months for me to come? Should that really take that long?
