I am Green Holder in US with 3plus years for residency.I applied for Candian Citizenship in 2004( landed immigrant frm 2000, but never lived there) They started processing my application in Jan 2005. Letter was sent to me in Mar 2005 requesting some information regarding my trip to US. I submitted that saying i visit friends in US.
They also sent letter in sept 2005 requesting finger prints. I didn't go for finger prints and left hope of Cndian Citizenship.

But today I recevied a letter at candian address asking me to appear for citizenship test.

I also had one incident before applying citizenship. I applied for PR Card, when i went there to take it. They saw that i had green stamp on my passport and took copies of my passport.

What shld i do now, what are my chances. Please Provide you valuable suggestions.

1) Can I get candian citizenship or will they refer me to Judge and reject me.
2) Will it effect my green card status in US.
3) will it effect my Citizenship In US.
4) What abt border crossing issues?

1) Can I get candian citizenship or will they refer me to Judge and reject me.

--- Anything can happen. Rejection is also possible because you have lied by telling them that you visited the friends in the US and actually you never lived in Canada and were living in the US. Worst is, this lie was discovered and they have the photocopy of your passport proving that you are in fact a US GC holder.

2) Will it effect my green card status in US.

--- May be. Because sometimes the officers are of the view that you can be a Permanent resident at only one place...therefore they can void your PR status - it is at their discrition. (But cdn cannot void your US status and neither can US official void your cdn status. Each official has the authority to decide your status in his/her country)

3) will it effect my Citizenship In US.

--- Generally, if you are given cdn citizenship before you get your US citizenship, then you should be okay...But if you get cdn citizenship after your US citizenship, then mostly your US citizenship will be lost.

4) What abt border crossing issues?

--- It depends upon the outcome of your cdn citizenship process. If you lose cdn/US PR, then there could be an issue.

Fingerprints were requested in Sept 2005. I didn't do any finger printing.

Surprise to see test notification today. Are these two process different? I thought you will recieve test notification only after finger printing.

Do I have to take finger printing before taking test?

Hi,
The question you need to ask yourself is why did you apply for Canadian citizenship when you never fulfilled the most important requirement? I am referring to "1095 days of residence in the preceeding 4 years". However I will still attempt to answer you questions to the best of my ability.

A1. The "Citizenship Test" is meant to test your knowledge of Canada. However passing it does not guarantee success of your naturalisation application. If CIC suspects you of not residing in Canada during the period you have claimed in writing (perjury), they will request more proof from you. Remember the burden of proof is on you.

A2. Should not affect your GC status, since you have been residing in the US are a permanent resident. However I do know that both USCIS and CIC do share information. If (remote chance, but still possible) USCIS learns from CIC that you did commit perjury, they may look deeper into you whenever you next apply for any immigration benefit, say N400 a few years down the road.

A3. See above

A4. If CIC rejects you naturalisation application on the basis of you having given up Canadian permanent residence, then of course your Canadian PR status will be revoked. That will not bar you from visiting Canada, but it may invoke a few more questions than normal when you visit.

My intention was not to scare you or intimidate you. I am basically just drawing out the worst case scenario, assuming that is what you were looking for. However as a Canadian citizen (who lived in Canada for 5.5 years), I don't have a very high opinion of people who use Canada as a "backup plan" in case their US permanent residency dreams do not materialise. Do not take this personally, it is just a principled stand I have taken against all "Canada-Users/Abusers".
