US Citizen sponsoring Canadian - B1 to I130/I485

Hey there,

I am a US citizen and am wanting to sponsor my Canadian wife. I lived in Canada where we met and we moved down at the beginning of August. (We did not have the intention of getting married, she helped me get up my new job and home settled in and just ended up staying here). We just got married very recently and I am wanting to sponsor her. We both entered the US via car and drove down here to Texas where we rent an apartment. As a Canadian, she gets 6 months of visa free travel, which is up at the beginning of February. We just got married and are planning to file the I-130 and the I-485 along with all the other required supporting documentation.

We are currently wondering if there are any complications in the case and what we should expect. When will she get her EAD and when will the LPR come in. We are also worried that if those documents do not come back before the 6 months of her visa, what issues will we run in to. We just are wondering what sort of time line to expect and what complications we should plan for (if any).

As long as there was no misrepresentation at the POE (when you both entered) she should be able to apply for AOS without any issues. Her EAD will probably take 90 days after applying. She should get her conditional PR status within 12 months. Once she applies for AOS, her status will be "applicant for AOS". It will go beyond February, but that will not be an issue.
