US Citizen sponsoring 21 yr old brother

Hello,

I am currently a 21 year old studying engineering as an undergrad in the US and have a brother who just became a US citizen. From what I understand, he can sponsor me as a brother. However, I had the following questions and would appreciate it if you guys could answer them:

1) I hope to find a job after graduating next year. If I do get lucky and find a company that is willing to sponsor my h1b and then my green card, will the fact that my brother has filed my application affect the ability of my company to sponsor my green card?
2) Is there a disadvantage of my brother putting my application in? So if he applies for me, would companies not be able to sponsor my green card anymore since the application has already been made?
3) In terms of the wait times, I was born in Dubai, UAE so do wait times for family based sponsorships depend on the country of birth as well?

A1: No
A2: No disadvantage with regards to employment based GCs. However you will probably not get any non-immigrant status, except L and H-1B, once your brother sponsors you.
A3: Yes, visa number availability depends on country of birth.

Could you please clarify your answer two? From what I understood, if I were to apply for a tourist B1/B2 visa, then it would be denied if my brother's sponsorship application is in process? Does this include F-1 student too?

Yes, you will lock yourself out, in all practicality, from being granted a B-2 or F-1 visa. Not 100% denial for such visas, but very close to that figure.

If your brother filed an I-130 for you, you would not get a visa from it for around 10 years. Since you are already in the U.S. as a student, you would be stuck in the U.S. and if you traveled home to visit, you COULD be denied re-entry because of a known immigrant intent. The L or H1-B visa allows for a dual nonimmigrant and immigrant intent so those are safe paths while also having an I-130 filed for you. If you believe that you could get an H1-B, that would be a better path to a greencard in the future.
