US Citizen Dad & son lost green card

Hello everyone,

My son lost his green card. He is 18 years old and did not renew the GC when he was 14. I have been divorced from his mom for over 5 years. Mom and my children disappeared all that time. I have just recently started contact with my older son. We talked over the phone about his/our immigration issue.

The question that comes to mind is:

Can he become a US Citizen automatically because I am a US Citizen?
Does he have to apply for an I-90 form even if he plans on becoming a US Citizen?

Any help would be greatly appreciated.

If this is not the thread for this post...I apologize.

Worried Dad

I became a US Citizen on May 26 1995.
My sons birthday is April 9 1990
My original post says my son is 18...sorry I was sleepy. He is 19 years old. I was going to file a I-90 but if I do not have to that would be great.

When he applies for a passport does he have to prove that he was living with his dad? How?

He has not applied for a passport. I did not think that was an option.

To Triple Citizen:
He was living with me when I was a US Citizen. What can he or I do to get a document that will show that he is a US Citizen?

I think he would just show his birth certificate and your naturalisation certificate to prove citizenship.

You are the coolest person. I was looking at the passport website and if I provide proof of my citizenship that will suffice. I will do a little more reading.
Do you know of any age restriction because my son is 19?

Well, he had to be under 18 and living with you when you became a citizen, which seems to be the case, right? It doesn't matter if he didn't apply for a passport at that point. But, did he leave and enter the country on another passport? I don't know if that's an issue, but it might be.

He has never applied for a US passport. We live in 2 separate states. Would it be a good idea to make a special trip to my son's state...to be with him when he applies for the passport?

He is over 18, so you don't need to be there to apply with him. You just need to provide him with the necessary documents -- including birth certificate showing the parental relationship, your naturalization certificate showing that you naturalized before his 18th birthday, and papers showing that you had legal custody and that he was physically living with you before age 18 at the time of or after your naturalization.

He will need proof that he was a permanent resident when he was living with you before age 18, which might be problematic without a green card. I don't know if they will accept other proof such as the approval notice ... or an expired I-551 stamp in his passport.

I want to do things the best way possible. Would there be a problem if he just applies for an Application to Replace Permanent Resident Card? And, would I have to pay the $290 plus $80?

Explain the situation in the US citizenship section, and ask about the possibility of your son getting a US passport without first renewing his green card and how that would be done. If it can be done, it would be much cheaper and faster.

I don't know any legal stuff-but his seems to be the best option. Nowadays, the greencard process is taking for ever. Plus if he is a citizen and you apply for greencard, that would unecssarily complicate everything.
