Hi, I know of a relative who, along with his wife, was granted visas. However, his child is over the age of 21, so the child was not granted a visa. Is there a way to allow the child to come with their parents without having the parents go through the process of sponsoring them when they arrive?

if let say the parent granted GC from overseas, and when they apply for it their child was under 21,
Does the immigration counts from the date the application submitted and of course when the child was younger? or when they were granted the GC status?

because in this case when they apply for the GC, and let say 10 years ago, their child was 10 years younger, so?

No. The parents will have to sponsor the unmarried son/daughter once they get here. It'll be a lengthy process, and if the son/daughter gets married, they will become ineligible until the parents naturalize.

What if they were granted visitor "visas" or any other type of non-immigrant visa? the OP needs to specify. What the heck he is talking about :rolleyes:
 
since they are immigrating, the kid aged out (most likely). How long ago did the kid turn 21? if the immigrant petition was filed for him as well, they may be able to use a priority date portability rule. But they should use a lawyer, not "a friend on the forum" method.
 
Thanks, but I'm not sure on their lawyer situation. They didn't ask me to do this, I just heard about it and thought I'd see how I could help by asking on this forum.

The kid has turned 21 for a year now, and an immigrant petition was filed for the kid as well.

then, if they are interested, they should read up on immigration, PD portability, and get a lawyer, if they want to.
