Urgent question regarding the photo for DV-2010 .

I applied to 2010 Dv lottery. I used a pic similar to this.

http://img135.imageshack.us/img135/2504/mohamad1sm4.jpg

I know that the shoulders are not quite visible. I didn't know it was required to show shoulders cuz in the instructions, it says face at least 50% of the pic and nothing about the shoulders. Later on, it was written on the Photo Validator page that the pic should contain the face, neck and the shoulders.

Regarding the rest of the specifications, my pic is good.

My question:

Will it hurt my entry ?? Is it that bad not to show the shoulders ( The neck is visible ) ?? I think what matters more is the face and neck cuz they reveal the identity ( or I hope so ).

Will I be disqualified from the beginning ?? or cases like that continue to the interview ??

Previous DV winners, can you tell me if any of you had a similar pic. and still won the GC ?? Please it will be like a pardon from hell.

Any input is highly appreciated

In my opinion the head is too big and the photo is out of focus.

Thanks Tazmania for your kind reply. I know this photo is out of focus but mine is not. It's just an example of how big the head in my photo is.

What do you think ? Will it disqualify me only cuz the head is big ?

please, kindly reply.

Sorry, Tazmania. I didn't make myself clear enough.

I've already applied with a pic where the head is that big but otherwise good.

My question was : " Do you think it will disqualify me from the beginning ? "

This is my first time to apply so I was so excited to apply on the first day. Now I regret it and wished that I waited to learn more about the photo requiremnts from you guys.

The head is definitely too big. It should be not more than 414 pixels in height. But it is 470 in height. However, I am not sure you will be disqualified.

Thanks raevsky for the reply. I knew that after I applied ( very disappointed indeed ). I waited this lottery since last April.

Do you think it will disqualify me from the beginning ? or do I have a chance to get to the interview when I can explain ?

The size of the head did not mean much in previous lottery programs. I am not aware about disqualifications because of that - there were a lot of various head sizes among winners. But the instructions were very vague too. This is the first year the instructions are very clear.

You're right revesky.

The instructions on the Photo Validator page were saying that the shoulders should be visible.

However, the PDF file for DV-2010 instructions didn't say anything about the shoulders. It only said that the face should be at least 50% of the size ( not the height ) of the photo. That's why I focused on the head and neck.

There's contradiction between both.

However, it relieved me a little bit that you said that The size of the head did not mean much in previous lottery programs. I hope it doesn't in this one too.

I hope that it doesn't disqualify me cuz I strongly feel there will be no DV-2011. So, now or never.

This particular instruction is still incorrect, as it has always been. However, only this time it became clear this instruction was incorrect and misleading. However, in previous years they accepted both images with correct sized heads and incorrect sized ones.

Thanks, sugar pie for your reply and assurance.

I know that nothing is for sure. I just wanted to know what you think or heard from others.

That's also why I needed some DV winners to share their opinions cuz maybe one of them had a photo defect like mine and still won the lottery.

BTW, I am from Egypt too.

@ raevsky :

They should remove this part from the instructions PDF file.

However, in previous years they accepted both images with correct sized heads and incorrect sized ones.

Oh God, say it again and again, please. It gives me hope.

They should remove this part from the instructions PDF file.
Is is not that easy. It is a part of text of the law. Probably, Congress should act first to remove it from the text of the law (22CFR 42.33). Then they will exclude it from instructions. They cannot remove text from the law on their own. Surprisingly, they could produce instructions and examples that mathematically contradict the law.

http://edocket.access.gpo.gov/cfr_2008/aprqtr/pdf/22cfr42.33.pdf

(iv) The person being photographed
must be directly facing the camera
with the head neither tilted up, down,
or to the side. The head must cover
about 50% of the area of the photograph

That is another reason why they will probably not disqualify application for the head being too big - because the law demands it to be too big, while the DOS instructions (that should comply with the law) contradict it. Obviously, Congressmen made a mistake. However, on the legal side DOS instructions and examples violate the law.

My Friends!
This is a Green card Lottery and It is NOT a Photographic exam!!!:D

They won't disqualify anybody in the first step for these matters! If they wanted to do this then the photo validate check link in the registration form would don't accept these type of photos!!!;)

Common please be relax and don't think about that very much!

The validator does not have technical ability to check those things. So, this argument is not a valid argument. Is has only technical ability to check things that could be checked easily - resolution, RGB format, number of bits, file size

Could someone please tell what is the size of the paper picture in cm or inches?

Thanks

That's right. It actually confused me being my first time to apply.

I hope they comply with the law cuz if they don't, nobody will know about it. One will not be selected as millions which don't get selected. So, no proof, no case
