URGENT question on L1 to H1 transfer ! PLEASE HELP!!!

I am currently in L1 visa which expires on Dec 2007. My H1B got approved thru a consultant. The consultant says that I have to switch to the H1B visa on Oct 1 2007 becaues on Oct 1st the L1 becomes invalid and H1 becomes valid. He says if I don't switch then both my L1 and H1B visa will become INVALID. Is that true ?

Can I still stay in my L1 visa until December and then switch to H1B during December ?

what if I go to India for vacation in October and come back with a renewed L1 visa ? will my H1B visa get invalid ?

PLEASE HELP!!!

If you didn't get I94 with H1 approval, that is not true.
 
Thanks for your reply! Since I didn't get any I-94 with my H1, I guess I am not forced to switch from L1 to H1 on Oct 1st itself.

Is there any timeline within which I have to switch to H1 ? say like 1 month or 3 months ?

I think that your H1 is valid for the period as printed in the I-797 approval paper. Since your L1 visa is expiring(most likely your I-94 too) you should apply for switching before dec 2007. Better atleast 2 months, since it takes 6-8 weeks.

I think that would invalidate your h1. So better get stamped for the visa which you are interested to travel in.
