URGENT- Possible I485 RFE: EAD, AP processing ?

Hi folks,

I had gone to the local INS Office last week to get my INTERIM EAD and AP, which I got. But the officer at the counter told me that there is something missing in my pending 485 and that the INS had mailed a letter regarding that in Jan 2004, which we never received.

In the last 2 years I have never received any documentary proof of my 485, except a small yellow receipt from the local INS office. I 2002 I had changed my address and had mailed the AR-11 form to all the relevant INS Offices.

Q1:- If there a possible RFE on 485: Will I still get approval for INTERIM EAD & AP ?

Q2:- If the 485 is DENIED/REJECTED: (Since RFE's must be responded within 12 weeks, but we never received anything) Will I still get approval for EAD & AP ?

Q3:- Can I still go out of USA on AP and come back ? OR I should wait for INS to re-send that letter again to my correct address (as last week I called the INS to advice them of my correct address) ?

Please advice.

------ did you also updated your address with the USCIS service center where your I-485 is pending??? I mean not just calling I-800 NCSC as they are BS, did you or your lawyer who filed I-485 updated the Service center that your address on pending I-485 should be changed? Did you check with your lawyer if he got any RFE for your I-485??

Thanks Ginnu, for the update.

I and my lawyer had mailed the change of address to the local office too. But no effect, I guess. I personally, had gone to the local NY Office to inquire about the 485. But they ae totally incompetent, and told me tha my case has been moved from the NYC local office to MO Office, and that I have to write a letter to them to get the info on RFE and my 485 Case/Receipt Number...

The local NYC Officer even gave me mine 485 Case number, which when I tried looking it up on the USCIS website, give me validation error (MSCxxxxxxxxxx). The number does not exsits!!!

Even calling the 800 number is not much of help, as without the 485 case number they cannot do anthing.

This is so BS going on now

I am totally lost now...
