URGENT PLEASE HElP FOR RESCHEDULE CITIZEN INTERVIEW

i applied for my citizenship in last year June 2009. i had the interview on Aug 2009. some how i don't have my one paper with me that time. officer told me for reschedule interview after 60 days in that 60 days i have to go out of country. i request for next year after Feb 2010. when i came back in united state i call in immigration office and they send me letter after week. its says you have to wait 3 to 6 months. now i am calling every month they are not giving me any response. every single time they giving me new time. 2 months ago i was gone in immigration office. that time officer told me your file was in dead zone now i am going to pull your file out and you can receive your interview in 2 weeks. but i am still waiting form last 2 month. last month they send me new letter its says you have to wait 60 to 90 days.

Also whenever i try to check my status online or by phone they cant find my file. after that i have to talk officer then they give me some information.
All Officer says we don't know how long gone take.

Now i am so confused i don't know what to do?
Please some one help me.
 
Did you passed your tests? Did he give you a letter on interview date saying you passed the test and a decision cannot be made? If he/she did then you can file a suit in district court under 8 USC 1447(b), that will get things done in no time, I filed mine on May 13th, 2010 and was approved on June 14, 2010 and was given oath on June 18. All done in 35 days. When you file a suit they have to respond to court in 60 days. This is a guaranteed win win situation if you qualify but are facing unnecessary bureaucratic delays. And best thing is you can file yourself without a attorney, it just cost me Under $400 and quite a bit of time to prepare it, but I got my citizenship done thanks to the law for people like us and this great forum and people here which had all the information needed.
A lawyer was asking for $5k to file the suit for me but i did it all myself.

yeah officer she give me 1 letter that time. its says
" A decision cannot yet be made about your Application."
" You will be given another opportunity to be tested on your knowledge of U.S history and government."

USCIS wasting my time since from last one year. i have to move in different state and i am just waiting for my reschedule interview. so i can move in different state because my parents are moving. so i have to move with them i cant stay by myself.

what about if go for info pass can they take my interview test or not?
also when i applied for my N400 that time i was unmarried in November i got married. so what i need for that.
my husband he is in India he e-mail me some paper written by court. i don't have my marriage register yet. so i don't have marriage certificate.
what i need for that?
Please Help Me I Really Need to Finish This Case Soon As Possible.
 
So you actually did the interview? In the first message it seems like they turned you away and didn't do the interview because you were missing one document for something. What actually happened?

If you had the interview, that gives you better options to push USCIS to act on your case ASAP, because they are supposed to make a decision within 120 days after the interview.
 
yeah i had the interview. even i don't know what i can say because that day i was really sick i had fever etc. so i don't who i can blame to myself or officer.
i was moved from different state to Texas.
I did not change my driving license. my driving license from different state. officer told me that if you had different state driving license she just had 2 options.
1. she can move my case to that state.
2. or she can give me 60 days after reschedule interview.
so i choice for 2 options because i don't want to go different state.
i did not change my license because i usually traveling different different state.
but she did not listen me she just says" where ever you applied for N400 you need that state driving license"
that's what happen with me that time.
 
Your case is bit complicated because of your moving around, we can't suggest anything until you explain the whole thing, Most important questions are ;

Did you passed your test on the interview?
What was the one paper that you didn't have at your interview?
Did you ever received a RFE from USCIS?
How long have you been a resident of your current State after you have moved?
If not your license have you got any utilities, bills in your name in the new State you moved to?

We understand your frustration as you probably want to sponsor your husband after you become a USC, but you have to explain the whole scenario to get accurate suggestions, because if you did passed your interview now because of your move you might have to prove jurisdiction of the court in the area you live in now and you have to be a resident of a certain place for a certain time before they will have jurisdiction, if you have to file 1447(b).

No i did not passed my test because i practiced old test. i was confused. also i was really sick so i don't what happen with me that day.
something like utilities bill or bank statement. so i can proved her my certain place in Texas not any different state.
no i never received any RFE.
after 2 year's i moved to Texas but since last one i am mostly in Texas.
yeah i do have some. but right now i changed my driver license. now i have Texas driver license.

Make a info pass and ask them specifically where is your A-File, it should be at the same office where your interview took place, if it is ask the IO to see a supervisor of DAO's, ask nicely and firmly and insist on seeing the supervisor. If they have the file at that office then it should not be a big issue for the supervisor to give you another appointment for your tests, if the file is not there then ombudsmen or Congressman/Senator should be the next step, there is a slim chance your file may have been sent back to the main warehouse in Lee Summit, MO.......
At this point since you did not passed your test, filing a lawsuit is not an option.

That's not entirely correct. While the OP is ineligible to file a lawsuit under 1447(b), he/she can file a straight WOM lawsuit to compel the USCIS to schedule his interview. A few years ago, when some applicants were getting stuck in the name check process for extended periods of time, it was not uncommon to file a Writ of Mandamus lawsuit to get the USCIS to adjudicate an application.

last time when i gone to info pass officer told me that my file was in dead zone. that time he going to pull my file out and i can receive my interview letter in 2 weeks. so that's mean my file still in that office not any different place.
yesterday i made info pass appointment again for this coming Friday. so lets see what going happen that day.

In a situation like this, where things have gone significantly off the rails, simply going to INFOPASS appointments is not likely to solve the problem, as your own experience shows.

In addition to INFOPASS, you should also contact the CIS Ombudsman and your members of Congress (the two U.S. Senators for your state and the member of the U.S. House of representatives for the area where you live). Members of Congress have special staff for dealing with constituent requests regarding immigration services. USCIS is likely to respond faster, and more honestly, to congressional inquiries than to your own in inquiries and sometimes a bit of an outside intervention is exactly what is required to dislodge a stuck case.

Your case must be filed for 18-24 months before a case is considered "Ripe" to bring a Mandamus action.

Not true. There have been cases that were pending for 12 months where a successful WOM was filed. In fact, there is no predetermined timeline for a case to be considered ripe. In the case described in this thread, the applicant's background checks have been cleared and he is ready to be interviewed. The only purpose of WOM would be to get the USCIS to remove the case from the "dead zone" and act on it, as opposed to expediting the background check.
 
here is very interesting story.
i had info pass appointment on friday. guess what happen. i talked to officer tell her all story. she told me for wait after 1, 1:30 hours she called me again and she says that we can take your interview..because your waiting since one year also you are driving so long to get here. i was ready to take my interview. i gone to upstairs and waiting for my interview. after wait 20,25 mints officer called me. officer ready to take my interviewed he asked me some question about my personal life. i given him all right answer when he asked me about county. he could not find our county in his list. then he confused he told me to wait. he go for supervisor to ask him what happen? supervisor tell him this county in different city we have to transfer this file to different city. officer came back in his office and tell me all story and he said that we can't take your interview we have to moved your file.
again they did not take my interview. i have to wait again. its was my bag luck. :(

Here is the help....USCIS works on its own schedule, so when you rescheduled for 60 days and never showed up, you added a wrinkle in your naturalization process. The officer who told you he/she can move your case to your current district office or have you come back after 60 days was wrong to give you a choice. He/she should have moved your case to your new DO. The USCIS administrative manual is very clear when it comes to jurisdiction and adjudication of cases in the correct DO's. You should have asked for your case to be moved into your new district as the law dictates. As of now, you will have to wait for your file to be moved to your new DO, wait for them to schedule you for the interview and just hope you aren't waiting another 6-9 months. However, the blame for this entire saga falls squarely on you, because if you read a little about eligibility criteria, especially when you change states, you would have told the office at the initial interview to just move your file then, you will be a citizen by now, assuming your morals are in order and you a tax payer.

The only help is for you to wait and make sure you feel well on the day of your interview in your new state DO...

hey guys thx for your help.
once again i had info pass appointment july28 in different office. i asked for my file officer told me they did not get my file yet. he told when they get my file they can call me. after 1 week thursday morning august 5 officer call me. he told me he get my file and he want schedule my interview. he told me after 2 weeks means august 19. i asked him there is any possibility i can come before that. he check everything and he says how about tomorrow afternoon means august 6. i says yeah its f9 i can come tomorrow morning. he setup my interview at morning 8:15am. he checked my all documents and ask for my marriage proof i have everything with me. he ask me 6 question. i give him all right answers and i passed my test. now my oath gone be next month September 15 at morning 8:30am.
