Hi there,
My employer applied for H1 visa extension back in Oct, 2002. My I-94/visa stamp was expired in Jan, 2003. Recently I got visa approval without i-94 attached to it. Can I revalidate my visa here
in St.Louis instead of going to India get it stamped. If so will I get new I-94 with that? Does anybody know regarding this. How many days can I stay in US after my I-94 expiration date. I would appreciate your help. Thanks
 
your i94 determines your status. (st louis will only do visa stamping)
You are technically out of status from jan 2003.
So leave usa ASAP to get a new i94.

if you stay 180 days past your i94 date = 3 years ban
past 1 year = 10 years ban.

The more you delay in leaving usa , makes you more difficult to enter again.

One quick Question, Do you know why did INS sent you the visa extension without I-94 coz from your case it seems you applied for visa extension well before the expiry date.

I think you should appeal to get this case reviewed. Did you send the copy of I94 with the application? I have seen a post in this forum long ago when somebody had the same problem, fired the lawyer and found another who appealed and then was granted I94 with proper start time.

You are not out of status from Jan 2003. But you can continue working only after getting the new I94.

But my employer says I need to go back to India in order to get new I-94. He saying BCIS didn't issue I-94 extenstion, becos we couldn't submit 2 months paystubs ( I was on the bench for 2 months before starting this job). Would you please tell me whether I am in out of status? If so from which date it starts, whether I-94 expired date or my previous job end date? I would appreciate your help. Thanks
 
OK so you did have a pre existing problem. meomeow is right I94 expiry date determines your expiry of status.

My emplyer talked to BCIS people, they said H1 got approved without I-94. But he has not recieved Approval Notice yet. And within two weeks I will cross 180 days (From I94 expire date).
Would you please suggest, Do I have to leave the country before 180 days OR Can I wait for Approval Notice then leave?

Leave US ASAP .
wait for H1 approval notice from Employer in home country, get H1 passport Visa and then enter US with new I-94

Jaxen, when you say extreme conservative approach, does it mean safe approach?
