Urgent : Need suggestions for spouse changing company

Hi ,

I have seen many postings and they might be related to my query , but just wanted to clarify .
My husband's 6th year expires in june 2005 and currently has a pending LC from company A.
Company B wants to hire him and they are ready to file for his h1 transfer +7th year extn premium right away (based on company A's pending LC) and also for a new LC before mar 24th.
He should be getting his offer letter in couple of days and the process might start late this week or early next week.
DO you think this is doable ?

He is planning to join the company B only after his 7th yr extn is thro and LC is filed before mar 24th
Any suggestions / risks involved in this ?

I am also on h1 with LC pdd of june 2003 and my 6th expires in dec 2005.

Its perfectly doable. If you have a pending LC for > 365 days with Company 'A', you can get a extension of 7th year thru' Company 'B' using pending labor of company 'A'. There shouldn't be any problems with it at all.

Our problem is only with the new LC to be filed , is it doable within the next 10 days . We dont want to wait for PERM , instead would prefer a regular LC from this company B so that we dont have issues in getting further extensions

You can do that too (keep in mind it has to be done before PERM goes live if you are planning that way). As long as the LC is filed before filing the H1B extension, you will get extension of addl year based on the new LC.

Looks like you want to file for new LC under current system and not PERM. Since you have only 10 days on hand you may not be file it under RIR if the new employer has not completed all the groundwork by now like advertising etc.
You can very well file it under regular (Non-RIR) process in matter of days.
