Urgent! Need suggestion!!!

I am DV 2008 winner and I am planing to file I 485 in July.

I came to usa for study to get a master of computer science. After graduation, I had OPT and I found the current job, which is related to my bachlor degree but totally different from my master degree. Therefore, I used my OPT EAD card to work current job. I also count the work experience from OPT in the DS 230 and etc. form to KCC.

However, I plan to file I 485 next month. Today, my lawyer told me that for I 485, I'd better to count from the first day of my H1b effective day rather than from the OPT effective day. She said OPT should work for related field, which is computer science field.

Here is my concern,

I already sent my DV forms ( DS 230 etc... ) to KCC. The work experience I wrote was started from the OPT, not the H1b effective day. There are alomst 8 months difference gap. And it would be total different from the date I provide on I-485. Will it be harmful for my CP for DV? Will they find the info I provided are inconsistant? :confused:

did you mean to say you were a 2007 winner?
Because if you are a 2008 winner you cannot file before october 1st 2007. You can only file when your number becomes current. If you apply before your application will be denied and you may loose valuable time and money.
If you are a 2007 winner and your number is current this July then of course you can file your 485 but keep in mind you have only 3 months. Now, this may be generally be enogh time but if your case is not clean (i.e. doubts about being out of status while on OPT) you may run into problems and delays.
I would seriously consider doing CP.

maybe someone else will be of more help and give you better advice. this is just my humble layman opinion.

Sorry... I should mention that I 485 I will file is more employeed-based. and DV 2008 I will do CP
 
on both forms you have to reflect the jobs and time period that you have actually worked, and not what's more "convenient".
