URGENT - Is H1b transfer possible without paystubs ???

Hi All,

I have worked in the US for two years from 2000 to 2002 on H1b and went to India. I have recently come to the US again on H1b in Feb 2005, through "X". I learnt that "X" was planning to close its business, so I got my h1 transfered to another consulting company "Y" immediately. This company, "Y" transfered my H1 and received an Approval Notice in May but have not been able to place me, although they had started marketing me since April.

Recently I applied for a permanent position, in "Z" and I got through but this new employer is not letting me go. He has not paid me, hasn't given me any pay stubs and is also holding the Approval Notice which he received. In this context I have two questions:

1. Can I take up this permanent job and can the company, "Z" file for my h1 transfer without any pay stubs?

2. How do I maintain my legal status?

2. How do I maintain my legal status? If you continue to stay with Y with no pay stub for quiet some time you will loose your status automatically.

You might be in some trouble ... basically you don't have any paystubs going back to Feb 2005 ??

You definitely need to inform Z's attorney about this and see what they tell you.

Your legal status may already be in question as H1 requires pay as specified in the LCA to maintain legal status.
