Urgent: i485 wait, Employer c11, outside country

Hi everybody,

I am currently working outside the US for my employer, who, per all rumors, will be filing for c11 very soon (as in this week). While nobody at this point knows what it means immediately, there's an option for them to complete cease operations and send all the employees home. Can anybody please tell me what my options are in such an eventuality? Your response/advise/suggestion/opinions are greatly appreciated.

You certainly have to find a way of coming to US and looking out for a job immediately. Do you have a visa currently? If so, don't delay further and come here and start hunting for a job. You do not want to jeopardize your GC which is so close to approval.

You can also come to US if you have a valid AP and start working with some other employer on EAD, provided you have one already. Otherwise you should apply for one immediately. You will not be out of status if you do not have a job as you are already on Adjustment of Status.
 
You must make all means to get back into the US immediately.

I assume you were here in the US before. Did you choose the CP or the AOS option? You will be safe if its AOS and if you have a valid H1 to return to the US rightaway.

Once you are in the US, you will be on AOS pending and you will have to obtain a comparable job at the time of your GC approval.

Thanks for the replies. I have my AP and EAD with me. I am going thru the AOS. Would this help if I were to return in two weeks time (as opposed to right away)? My concern is at the port of entry - will I be stopped from entering the US if at the time of entry (with valid AP and EAD) I am out of a job? Any thoughts are very much appreciated.

I don't think that the POE officers will ever know that you are out of job at that particular time. So, if you have valid AP, you shouldn't have any problems at POE. It is wise to enter US ASAP and look out for a job immediately. Please make sure you also have your 485 receipt with you at POE, just in case.

With your AP and EAD, you will not have any problem entering the US at POE. 2 weeks to return is ok but in this situation, the earlier the better.

Your status is AOS and so, you should be fine. Just return coolly w/o a stressed face or sweats on your brow.

Note: Some folks like you have been very blessed getting GC approved w/o RFE or Interview. You could be lucky too but I wouldn't count on it. Expect the worst-case scenario and obtain a comparable job as soon as your return.

I agree, you should not have problems getting back....

Being Nov RD you should be hearing from INS soon, and you need to do emergency planning, in case of a RFE you will have paystubs but not employer letter... try to arrange that somehow before your company implodes.

Try to find another job, INS gives 12 weeks to respond in case of RFE, you should be able to provide continous paystubs form 3 months.

Thanks everyone for your replies. My anxiety now is at a much lower level. Also, it looks like my employer, regardless of the action they will take, will keep me until my return to the US. Heeding your advise, I have procured an employment confirmation letter from my current employer - in case I get an RFE in the next week and half. As of another job, well, I am hopeful that I will be able to switch jobs as soon as I return to the US.

Thanks again for all your help and advise. Now if only INS were as considerate....
