Urgent.....I need H1B visa! How?

I am offered a work contract at a private high school in Virginia. I need to file a petition for a H1B visa. My education and teaching experience qualify me for the job. My problem is I need to be there on Aug 15, 2005 which is barely 3 weeks to go. Can a lawyer do the filing and other procedures on my behalf? How long does the US Labor Dept. or INS process the petition? If I get an approval for H1B from INS, is there still a possibility of being denied a visa from the Embassy here in my country? Please help! Thank you in advance. :)

It is not clear, where are you now? Inside US or outside?

if you are out side, sponsering school attorney can do all the works on school behalf to get your H1 petition approval. If they apply through premium process ($1000 extra), you will get your approval with in 3 weeks times. But you can start working only from OCT 1, 2005.

However, if you are out side USA, your consulate have full authority to issue or deny h1 visa stamping based on too many creterias.

By the by, do you have US (VA state -where you are going to work)teacher licenses/credentials, without that either approval of H1 or stamping may be difficult. (Private school may not need license /credential but INS and consulate will look for it to deny your visa)
 
Thanks, great guru! I have my PRAXIS I and waiting for the results to come out end of this month. Also, I have a masteral degree in Education with over 15 years of experience as a classroom teacher here in my country. I am also a licensed teacher here and I have had several awards in the service, too. I had my ceredentials evaluated by legitimate US credential evaluators who certified that I have BS and MA degrees equivalent as per US school standards.

Is INS/USCIS now accepting H1B petitions? Do u have other things to share about applying fo H1B that I need to know since this is my first time to go into this process? You are a great help to many who are in confusion here. Thanks to you.

Which country? US only accept US license only, no other license.
Is INS/USCIS now accepting H1B petitions?
From April 2005 , accepting H1 petitions.
Do u have other things to share about applying fo H1B that I need to know since this is my first time to go into this process? You are a great help to many who are in confusion here. Thanks to you.
But check the license? Your school may not aware of INS requirments.
 
I am from the Philippines. Praxis I examinations will give me the license to teach in Virginia. I am hopeful and confident that my results are good enough. Results will be out very soon.

Thank you for your knowledge about H1B. I feel better now, worries are lesser. One more thing, how much do u think would cost me if I hire an immigration lawyer that would coordinate with my employer and to INS? My school employer guarantees assistance in documentation and nothing else. Can my lawyer accomplish this for me till I go to the Consulate office here in Manila for visa stamping?

Attorney Fees varies from $1000 to 1750. (Excluding filing fees to INS, credential evalutation and courier charges)
My school employer guarantees assistance in documentation and nothing else. Can my lawyer accomplish this for me till I go to the Consulate office here in Manila for visa stamping? No. Not all. No attorney guarantee you getting visa stamped in your passport. Their job finished once h1 petition is submitted to INS in US. Responsing to any RFE (Request for Evidence) etc.

Say, INS has approved my H1B petition, what are the usual questions a consul would ask during interview at the embassy here in my country? How am I going to convince him/her that I must go and take the job waiting for me in the US? How much chance do I have on having my passport stamped by the Embassy?

Usually H1 visa stamping, chances are more to get it - unlike F1 and B visa where you have to prove , at the end you are going to come back to your home country and no intention of immigration to USA.

but H1 (Non immigrant visa) it has dual intention you can seek immigration through Labor Certification and live in US permanently and no need to go back to your home country at all.

Counsel at US embassy should not suspicious about your sponsering firm and your qualification , experience and degrees,

Good luck, do not worry too much, kabayan chap chap, you will be issued H1 my friend.

You are correct, officer will approve the h1B in the premimum process with in a "day", that 'day' may take one week from mailing the papers and assigning the papers to the officer and the officer mood to look at it.

Even after approval it may take minimum 4-5 days before sending the approval notice to your attorney, however you can check the approval info on-line every day.

I am not from your country, but in 1983, more than 40 people from your country working under me in an Engineering design office in Dhahran, KSA.(Very good stylish hand writing in drawings, they never use stencils)

A special friend will be coordinating with an immigration lawyer to start the process next week. We will have the premium processing for the petition. Also, does the DOL/USCIS need to see original copies of my documents or credentials? Or, photocopies are good enough for them to evaluate my qualifications? What are the papers they need to see aside from transcripts of school records, diploma, crimininal check certificate, US credential evaluation document, copy of license to teach?

Photo Copies are more than sufficient. You have listed almost all the documents. Even if anything mssed INS will ask your attorney to produce it. SO no need to worry at all.

Great Guru, thank you so much! My papers are now being readied by an immigration lawyer in the US and soon to be sent to Vermont. I read in this forum that on premium processing his H1 is out in 6 days. That information made me more confident and hopeful. I need to go to the US Consulate here for stamping after the USCIS process. Is the paper from USCIS be forwarded to the Consulate office here in the Philippines? What should I bring to the Consulate/Embassy? What are the things that the consul may check? What questions are usually asked to an applicant? GOD bless u always! :cool:

There is no set of question all depends on the counsel who is going to interview. When I came here 1996 on H1, I was not even interviewed and asked to pay fees in the counter through PA system.

Documents, all the papers come from US (attorney) your exp and credentials like degree, licenses etc and ofcourse PP all in original.
 
Urgent :Premium Proceesing for H1B

I am applying for H1B to start working from Oct1,2005
How much advantegeous it is in comparison to regular application with regards to getting in the queue before the cap reaches?At this time i.e.2 mnths left for oct 1,do you think one should go for premium processing only as the cap must be abt to be over?
Pls advise me .

If money is not the issue, go for Premium.

My attorney has already filed the case in regular status.She says that its not possible to convert before getting the reciept.How many days it take for getting the reciept and is there any way out to convert the application to premium before getting the reciept as waiting for the same may unnecessarily waste some time .

Without receipt, it is very hard to reference your application in the office, which has mountains of applications. Wait for couple of weeks
