what are the possibilities of filing a family petition and adjustment of status for a person who is on H4 visa status and is presently in the USA? :confused:

who is sponsoring who?

how are you related?

when did you get the h4 visa?
 
here are the details

:-US Citizen sponsoring her married sister (H4); sisters son (on H4) and spouse (on H1B)
:- H1B and H4 visa's were obtained in 2003.
:- further the beneficiaries are indians.

She can file the I-130 but there will be a 13 year or so wait for the priority date to become current. The priority date must be current for her to file the I-485. The priority date for brothers and sisters of USCs from India is currently November 1, 1991.

How to reduce 13 years backlog.

If your wife's parents are still not citizen, your wife's sister can sponser them immediately. Within 3 yeras they will be citizen. If they sponser your wife wait time is just 5-6 years. This category (III) priority date for India is Oct 1997 only.

By the way... the parents would have to get approved for GC, which doesn't happen right away. Then they would have to move to, and reside in the US for 5 years before they can even apply for Naturalization. Then they would have to fullfill all the rest of the naturalization requirements and become citizens.
At that point they would sponsor their daughter and who knows how long the wait is going to be in 2010.

I think we need to get some cousins involved here.

okay with the responses so far, here is the situation

I am on H1B in the US
My wife and son (17yrs)on H4 and with me.
My company is planning to file my GC from NJ but it may take 5 yrs for it to come.
Wife's sister is a US citizen
Wifes parents are GC holder's and are in the US

now the question:

in this situation: what is the fastest route to get a GC. keep in mind my son is 17yrs old.

Make multiple applications
1.Apply through your company
2. Apply through your wife's sister
later change in to wife's parents once they get citizenship. See which one comes first.

Now it works, they are already gc within few yrs they are USC, they can sponser. Think positively George F
