I hold H-1 and get laid off recently. I want to request a long time (for example, 8 months) leave from work without being paid. When I find a new job, I let my current company give me the last payment at that time. Is it legal?
Outright you are deemed to be out of status but It all depends on what INS will perceive in your case when your extension or transfer is up. There is no simple answer to this question.
