My H1 B expired on Feb 01 2004

My Labor Approved ( I think more that 1 year ago)

My I140 is also approved ( I think some it was Feb 2003)

I waited for marriage and along with wife in tow applied I 485 , EAD and AP

Wife got EAD 3 months ago and AP 5 months ago


I have not got EAD and could not get IEAD.

My questions to all

1. Am I in valid Status ? ( I think I am just want to confirm)

2. Can I still file for H1- B Extn now ?

3. As per my understanding , I will not be allowed to
get IEAD ( Interim ) for atleast till May 2004 beacuse VSC gave me an RFE in Jan 2004. Is is true

4. Since I do not have H1B or EAD or IEAD , should
not I go on leave so that I do not get paid.

----- you could have applied H1 extension or 7th year H1 extension before feb 01,2004

-------- why you did not get EAD? If not applied you will not get automatically if applied and have filed 90 days back then go to local USCIS office with EAD filing receipt and get iEAD

---- you are in valid status AOS pending but for work you need EAD or valid H1

----- NO, you cannot file H1 Extension now it was supposed to be filed before your H1 expiry date

----- count the 90 days again after sending RFE and check the BCIS online status and the day RFE received again wait for 90 days and go on 91 day to get iEAD from local office

----- Go on leave, for work you need H1 or EAD in hand, talk to your employer H.R if they can pay you later once you get EAD they can make some arrangements

I spoke to HR

My stamping expired in Feb 2004 but my visa is till Aug 2004

It seems that when the company changed names and location they had done something and former INS gave me 6 months extn.

My HR said they are forgotten to tell me about it ( how courteous of them )

I have applied for 485 , EAD and AP for my self and my wife in July 2003

My wife got EAD as well as AP but VSC has still not smiled upon me ...

I am still working ....

My company and me have come to an understanding that we will wait till April 2004 ( 90 days from RFE ) if EAD is not sennt by VSC , 7 year extn will be applied.

-----------Could you please make me more wiser? What do you mean by STAMPING expired in Feb 2004 and VISA is till Aug 2004
I hope your Visa stamp on passport got expired in Feb 2004 and you have valid extended H1 approval notice till August 2004 with extended I-94 attached with H1 extension approval.

VISA= Stamp in passport from consulate or from DOS
H1approval or H1 transfer approval or H1 extension approval notice= from USCIS.
Try to understand the difference and in future use the correct term so that others can properly understand the term used
