Me, my wife and our daughter are all green card holders since july, 2001. I will be taking my oath on 22nd of this month. my daughter was born in india. My question: Does she become automatic citizen of U.S the day we get naturalized.

If she is then i would like to apply for her passport? Has anybody had a similar situation and applied for their kids passport under CCA ( I am travelling to india this year) ? Any issues ?


Any help would be appreciated as I get conflicting statements? I am thinking of delaying my oath ceremony if I do not get a firm answer
 
Please specify the age of the child.

If the child is below 18 years of age and regularly (currently ?) resides in the US, you can apply for a N-600 form on her behalf.

Please look up Flydog's post as he went through this process for his daughter recently.

While the N-600 process can take a while you need to go through that only to get a naturalization certificate for your daughter. She does automatically become a citizen when you take your oath and so you should be able to apply for her passport right after that.

Does she need to send one of her parent's Naturalization certificate along with the passport application?

Can she send her application with her parent's passport application?

Unfortunately the original naturalisation certificate is needed for the parent and the the child applying for a passport. So the child's passport needs to wait until the parents gets his/her naturalisation certificate back.

Considering the wait for passports these days, I think it would be better to apply for N-600 and apply individually. Overall it might be faster to obtain both passports.

From your date of oath ceremony I suspect you are from the San Jose district office. Would you care to post your timeline, perhaps also in the San Jose thread? Timelines are very useful for other people to estimate how long each step is going to take. Timelines are so good that they helped me predict exactly which day I was getting my oath letter :)

Now, if your child is under 18 on August 22nd, yes it seems she will become a citizen automatically. You can apply for her passport but you'll need to send one of the parents original naturalization certificate along with her green card. Department of State is good about making assessment of citizenship with these documents (much quicker than USCIS with N-600). Some people "freak out" when they apparently don't see the CCA case under proof of citizenship in the website. If my memory serves me well, the CCA case is included in the DS-11 form itself.

You might consider obtaining a certificate of citizenship for her (form N-600), for this you only send photocopy of your, or your wife's naturalization certificate.

PS: If you're planning to travel this year I would highly recommend to apply for expedited passport.

PS2: What kind of conflicting statements are you getting? I wouldn't recommend delaying the oath ceremony, doesn't seem to make any sense.
 
3 statements that I have gotten so far

1) You do not need to send the naturalization certificate for your daughter along with her application, as long as you can show the original certifcate to the acceptance facility ( e.g. post office ) - Very Hard to believe this

2) You will have to send the original naturalization certificate of the parent along with application, which means that we will have to wait for our passport to come before we can apply

3) Called up post office - Certified copy of the naturalization certificate

First of all, people have a hard time understanding what CCA is all about. They will always go and ask their superiors
