Urgent help needed on TD status studying in US

Hi all,

My wife is currently on TD status living in USA. She wants to study at the local community college. The college refused her to register academic courses and told her that she can only be enrolled in ESL or intensive English program at the college. They told her that she needs to file I-20 to take actual academic courses such as Math, Science, etc.

I thought people who are on TD status are permited to study in USA. I did not expect any problem with her registering academic courses in the college. What should I do in this case? Can anyone provide a link to the official document that states TD visa holders are permitted to study in USA for any courses? I barely know what I-20 is. How do I file it? Any help is greatly appreciated.

Ask them for a written rejection notice that you can take to a civil rights attorney so that he can sue the school.

While I understand the importance of exercising my legal rights, I do not wish to fight with the college in court. I think they may not be clear about what TD status is. My wife needs to register her classes ASAP so she can be enrolled in this upcoming winter term. I need the official documentation from US government that says TD visa holders can study in US without restriction in order to convince the them. Can anyone help me with that? Thanks in advance.

I'll just print out the TN status section on State Department's web site which states person who is on TD status is permitted to study. Hopefully that'll be enough to convince the school official. I'm not very familiar with I-20. Based on my research, I believe it is a document that American schools issue to students to sponsor them for student visa (F, J and M). Since TD visa holder is already permitted to study in US, no such sponsorship from school is needed. By on TD status, my wife should already be granted the right to study in US without restriction (not limited to only ESL or Intensive English program). Someone please let me know if I am wrong.
