Hi,

I am getting back to the US just a week before I complete 6 months. The last time I was in November 2010, I was questioned at the POE as to the reason of my absence with details. My concern is that at POE do the officers check the multiple trips made on GC and track and ask questions. I had to be out for long gaps since a year for personal reasons but should be staying back on work now.

Are there been any cases about GC being taken back at POE on these grounds. Any help will be appreciated.

nope worst case, scenario, he let u in and send u to see a judge who ll decide if you keep the green card or not.
last time, you came, were u sent to secondary inspection? if no, chances are , he ll let u in with a warning.

The answer to your first question ("do the officers check the multiple trips made on GC and track and ask questions") is Yes.
When you re-enter the U.S., the CBP officers at the port of entry do look up your entry/exit record and if they see that there were a significant number of recent extended absences, they are likely to question you closely. When you last re-entered the U.S. after an extended absence, did the CBP officer give you a warning about the possible effect of extended trips abroad on your LPR status? From your post it sounds like they probably did give you such a warning. If yes, the warning also gets recorded in your CBP file and in that case when you re-enter the U.S. again, you'll definitely receive close scrutiny.

In terms of GC being taken away at the port of entry, they can't really do that. However, they can refer your case to the immigration judge for GC revocation. In practice, it usually takes several warnings about long absences before they initiate GC revocation; so if you only had one warning so far, you'll probably be OK this time around.

Multiple back to back trips under 6 months could put GC in jeopardy. Worst case scenario is that you are eventually denied entry into US for abandoning residency and GC.

If you have personal reasons, explain it to the IO if he/she asks. The chances of you being in serious trouble this time around are not that high, but you might be questioned.

naina, please tell us if you saw the immigration officier typing a lot. if you didnt then it was a verbal warning which , actually, doesnt count.

They could have typed in the info right after stamping the passport and telling you to move on. Sometimes I see them doing stuff alone on the computer for 20-30 seconds before calling me up to the immigration counter.

what i beleive a LPR should have everytime when entering in usa : taxes, bank statement, valid drivers licences.....Etc
So you 're always ready to show if needed that you live in usa/ or intend to live in USA.
one time the immigration officer asked to tell him again the adress that i wrote on the custom form then ask me to tell him which interstate and exit I take to go home?
I told him the interstate and also the exit number, he said ok and let me in.
My point is, you always have to be ready to answer questions and another advice, don't lie to an immigration agent.

re

thank you for the responses. I did not get any warnings earlier nor do I remember them noting details. having said that is it true that some POE's are more relaxed on gc entries than the others. I have heard that sfo,ny\nj and chicago they are more strict about this.

I will carry my taxes and us accts related information.
