URGENT - H1B renewal 221(g) at Mumbai...Have AP

Hi,
Please help. I was here to get married and now i am left toally clueless.

This is my second H1B renewal in Mumbai. Last year everything was smooth. But this time i got 221(g) yellow sheet. (My employer is still the same).
Questions:
1)How long does it take approximately to get the Admin Processing done? (Visa officer told me it should be less than a week)
2)I also have Advance Parole. Can i use Advance Parole and go back to the US or do i have to wait until i hear something from the consulate?

I hope things will be positive pretty soon.

You should be able to come back with AP, but you won't be in H1B status any more. As long you have EAD yo should be ok.
 
Thanks for your reply. My employer had just filed for my AP. They said only AP will be required to travel and you can work on H1B. Do you mean that H1B will become void if i use AP?

You may use AP to return to the U.S. However, the AP must be approved before you travel - otherwise the AP application will be deemed abandoned. Once you return to the U.S. you will be treated as a 'parolee' and you may use the EAD to work. In order to regain H-1B status, wait for the administrative processing and get the visa stamped by traveling outside of the U.S.

But isn't it mandatory to have AP before departing US if 485 is pending? Can a thrid party apply for AP when the beneficiary is not within US ?
 
Urgent: Returned to US on advanced parole?

Forum members,

I need your help. My wife and I are in India on vacation.

My wife went to US consulate, Mumbai for H1B visa stamping. However, her passport was returned along with a white document to fill out for verification of technical qualification and asked to email the requested forms to an email address for verification. (Please note: This is different from I797 verfication that started a month or so back) She was told that it might take 2 weeks or so to verify the technical qualification which will stretch her vacation beyond her original return date.

Q1) Can she return on a valid advanced parole document? Will she have issues during secondary inspection in US based on her experience at US consulate in Mumbai?

Q2) Does anyone have info on what technical qualification is all about?
