Urgent h1 info needed

I want to file for my H1 ( I am in H4, Ead expiring and GC going to be dropped), I just heard that the 2011 quota is over. If I file in Oct 2011 for 2012, when can I start to work ?

can I work immediately after its filed or wait till its approved ?
When will the visa be usually approved / disapproved ?

Can someone please provide some info
 
It has to be approved before you can work....but if you are on OPT right now cap-gap extension might me an option...check with your school..

Hi mkgirl,
You can start applying for 2012 quota from April 2011.

If you want to apply in Oct 2011, you are assuming that the 2012 quota will remain unfilled until then.

Suppose, the quota doesnt get filled by Oct 2011, and u apply apply at that time, you can start working as soon as you receive an approval.

-----Employer can file April 1 and then wait for the approval notice and if H1 gets approved then employer will get Approval notice and you can start working October 1.

----- Visa is approved or disapproved when one apply VISA with US consulate or US embassy. Visa Stamp is under DOS and Petition Approval or denial is under USCIS. Dont mix Visa with H1 approval.
