Urgent EAD Question

Hello All,
I have applied for 485,EAD and AP in Feb,2007. I am on H1 since last 3.5 years.
my H1 is expiring after couple of months
Is this true that I can not extend my H1 any more?

as you have been on h1 for 3.5years you can apply for h1 renewal (as a normal case). its better to maintain status as h1 rather than adjustment of status pending (I-485) for many reasons.

I have read in many posts that H1 can be extended only if
1. your labor is pending for more than 1 year
or
2. I-140 is approved and can not apply for I485 because PD is not current.

your employer can file for H1 extension.you are eligible for H1 extension. better remain on H1 status and dont use EAD
There are different opinions regarding this issue and every opinion has its own argument
1- If you are in stable job and your PD is very far and for sure your AOS will be pending for years and years, by which you will waste all 6 years of H, it is better to work with the EAD and renew it yearly. So, you will save 2.5 years left in your H in case your GC application gets denied.
2- The H renewal and extension protect you from sudden denial of your GC application and by then you will be out of status immediately, again if your PD is far, no one will touch your file to approve or deny you and for sure you will waste your H years.
3- If your job is not stable, the H will protect you from the employer to great extent. But still if any thing happen with your job, you will be obligated to use the EAD any where else.
So, manage it according to your situation.
