Urgent: EAD and Advance Parole

Hello experts:

I have to get back to my Attorney within an hour about this. They submitted for an H1 extension in March'07 and that is siting as "pending" - even my company paid $1500 for expedited process. As the priority date is current my Attorney is going to submit my 485 documents and she asked me whether I want to apply for EAD and Advance parole. Is this good thing to do? I know my wife would be able to start working with that. What is that going to let me do? Sorry I am not familiar with that EAD process.

My company a fortune 10 has opened a office in Bangalore, India and I was asked to go there to fix some stuffs. So if I go with that advance parole in India - can I come to USA without any problem? My H1 visa expired.

Please let me know as soon as possible - I would appreciate any suggestion/advise.

Yeah go ahead get the EAD/AP. Ain't no harm if you ain't paying for it eh?

As far as going to B'lore is concerned - you will have to wait for either H1 or AP to come! And you can come in on AP without affecting your H1.

I guess my situation exactly matches your.But my question is since my H1B is pending, and When I am filling I485 form what should I put for H1B expiration and I94 no. ??

I have the receipt no. of H1B & H4 which are pending. Please advice. Your time is highly appreciated.

Finger Print!

Thanks much for all of your suggestions. Yes I am not going to B'lore for now. I have an appoinment next week and following with doctor to get all the medical work done and hpoefully my Attorney will submit all documents by first week of July'07.

One more question I have for anyone who has experience with FBI finger print - I actually did that by myself for Australian Citizenship (which was approved in 2005 - but I did not go; that was my backup plan if I didn't have job here in USA!); so I got that done once for that purpose is it going to fast my papers work with FBI?

but one has to ask.. what exactly is EADs impact on H1B.. one indirect impact I can think of is that the emplyer will know that you have EAD and so will refuse to extend H1 as they will consider it a waste of money, so now you will be on your own to keep extending EAD whereas before the employer took care of extending H1

------------------EAD comes to your home address, if you dont inform he will not know but if employer paid Fee for EAD then he may ask the lawyer or you for EAD status if approved or pending, if you dont provide him EAD reciept # he cant know if it is approved or not

from what ur saying, i think u r implying that it may be best to apply for the EAD yourself with assitance from employer and company attorney so that you can use it in emergencies and that way it has no impact on h1 extensions whatsoever
