Urgent: company lost I-797 original: travel to India

My wife's company lost I-797 original.
She needs to get a visa from the US consulate
in Chennai.
We have bought tickets for travel to India on
31 Jan.
Can anything be done ??

Read the other posts. One can always get an answer. File I824 with INS and request a duplicate of I797. I do not think that you will get the duplicate within 10 days... Ask company to bear air cancellation charges.
 
Don't rely on I-824

I-824 (request for duplicate) I filed I-824, RD/ND 07/25/02. Still no response. AVM says taking between 150 to 200 days. Try something else. Let us know what happens.

I have another idea!

Can she quit her job. Get rehired with H-1 premium
processing a week later and the papers sent to India
for the new H-1 ? She goes for her visa with the new papers. Would that work ?

My wife is pregnant and this is the only window that the doctor will let he travel. Infact, we can get a letter from the doctor to this effect!

Please let me know!!

before a new H1 is applied for ? Do,
you think she will face any trouble getting
a visa in India ?

Just an update.

I had sent an email to Chennai consulate before I
left for India from US. Specifically, I asked if a sealed and signed envelop enclosing the photocopy of I-797 + a letter from the attorney stating that the original is lost can be used in lieu of the original I-797. The answer from Chennai Consulate was "yes".

My wife and I travelled to India and got the visa stamp by web dropbox within a week. Came back to the use with no trouble.
