I had an FRE on my I 485 which I sent on Nov 19, I have the same message on my status since 11/23/05. I also do not know what does that mean.

Received reply from USCIS

Today I have received a letter from USCIS for the enquiry that I filed about the delay in 485 approval.

The letter says my background investigation/check is still on and hence the decision on 485 is pending. As soon as the background check is done they(USCIS) will take a decision on my 485. Until then Jai Hind. :eek:

Does anybody know what sould be my next step.

Do you have the exact wording on the RFE notice? One of my friends has received a similar RFE and as per his lawyer, there is a way of getting around it.
From your signature, I saw that you did amend your application from EB2 to EB3. Did you try to get USCIS to process the case as EB2?

Here is my Q. Will they expect us to re-file or do they just convert from EB2 to EB3? We barely made the dates to file concurrently. If they ask us to re-file, me and my wife shall not be able to get benefits of EAD/AP and that would be such an unfortunate thing. I shall talk to the lawyer on Thursday where he is going to explain things to me.

Until then I am worries...will I have to re-file and loose 485 benefits? Or does USCIS simply convert EB2 to EB3?

To add salt to the wounds, just got an email from USCIS that my EAD has been approved and cards shall be mailed out soon, when ready. If my EB2 is not converted to EB3 and 485 needs to be refiled..it would be quite unfortunate..having received cards which are useless! :(

Does anyone have any info on above?

Nope I never saw the RFE notice. Also, since I was in 7th yr, I did want to take a chance and therefore accepted the offer.

I have not seen my 140 approval. What is the actual text of the 140 approval? Does anyone have a screenshot with personal info hidden?

Did everyone who filed in Sep'05 got 485 approval?? I know spidey did :up:

I am seeing this thread is sliding into 2nd page, is this mean everyone from Sep'05 got 140/485 approved and I am the unluckiest one??

Can you please share if your PD is Feb/Mar'02, receipt date is Sep'05 and you are still waiting for 485 approval, thanks in advance.
 
All EB1@VAC filed in sep 2005 is waiting for approval as date will become current from tomorrow.
