Updates:Did you file your 140&485 before Sept 30th 2005 retro deadline?

I140/I485 concurrent application

Hi,

I have been told it is not possible for a person in EB3 to file concurently I140/I485.

A friend just got her LC and she would like to file for I140/I485/I765/I131 asap so her husband can work.
Her lawyer told her that she can not file has to file for I140 first and then for the I485/I765/I131.

Is it true?
 
Unfortunetely yes. EB3 is subject to severe retrogression for all chargeability areas. Depending on your country of birth/citizenship depends on when a visa number will be available. You cannot file 485, 765 or 131 until there is a visa number available. The state department issues a visa bulletin monthly that indicates who can get a visa number. See the below website:

EAD for spouse not approved yet

Got an email over the weekend that my I765 is approved on Dec23rd. But there was no LUD on the spouse's I765 or I131atall until now. I saw an LUD on my I131, but no change of status. Is it normal to get approved at different times.

I140/485 - RD Sept 30th, ND Dec7th

I was out the forum for several months so I did not know.
My friend is from Japan so she will be under Asian number ...

This is really a bad news.
Is there some work around?

Consular Processing for example?

If she only applies for I140 once she get the I140 can she apply for I1485/I131/I765??
 
If your friend is from Japan she can apply for I-140/485/765/131 at once.
Japan is not a retrogressed country.

What was your 140 RD ? Any LUDs / RFEs before approval ?

I think it will be a good idea if people start updating their signatures with all the info like which processing center, what r the different RDs and different ADs on each app and LUD dates etc so that when we see an approval , we will know more on what dates are being processed.

Are you sure about that?
I have been told that since June or July ALL EB3 are subject to retrogression.
 
140 Approved

just got e-mail that 140 approved. Interestingly, it was approved on Dec 22 but the USCIS email and web update was done today. MY lawyer already has 140 approval. I am in EB2 cat. from India and I filed 140/485 concurrently and they were received on sept 29 by TSC. Does anyone know anything about 485 approval given the retrogression crap. thanks

got an email today that USCIS had sent a RFE on my I-140 petition. I was expecting this query since I've not submitted the ORIGINAL labor approval copy when I filed my I-140/485.
