Hi,
My friend when she applied for Asylum in 1992, they gave her a I-94 card with a pending status stamped on it and a date of 3/99. She was approved for Asylum in 1999. She did'nt realize until now that she never got a I94 card that says "indefinate Asylum status". What should she do?

Thanks for any help.

When this happened to me, I called my lawyer and he got me my I-94, but this was in 1998 (7 years ago). I know she is eligible for it.

Hi sal1786 -

I noticed no-one really answered your question, so I am going to take a stab at it.

Your friend needs to fill out an I-102 Form Application for Replacement/Initial Nonimmigrant Arrival/Departure Record. She needs to include a detailed explanation as to why she is returning her orginal I-94 and include evidence to support her claim for a new I-94 with her asylee status. She should include a copy of the letter given by CIS granting her the asylee status. There is a fee for filling out this form. Also, be prepared for it to take several months to get the new card.

I used this form back in 2002 to get my I-94 corrected when the incompetent immigration officers gave me an incorrect I-94 upon my return from a trip abroad.

Hope this helps your friend out. Let me know if you have any questions.

LolaLi! what do you mean by an "incorrect I-94 upon my return "??

How was it incorrect? what was written on it?

They had me as a Refugee entering the US for the first time. This means that my I-94 had an expiration date on it since Refugees apply for GC after one year and get it backdated to the day they entered the US (with no backlogg I might add).

I demanded a new I-94 with Asylee and indefinite work/validity on it. They issued me a new one.

easy way

listen you can go to your local asylum office and have it corrected for you.. you dont have to really fill out a form and waste money...

Please keep in mind that they will do it at the asylum office ONLY if the asylum office approved your asylum status. If the asylum status was given to you by an immigration judge they won't do it, but will send you to a deportation office to get your I-94.
