Hi:

I have a EAD and also a vaild H-1B. My company is going through a temp. layoff for all it's employees through first two weeks of July-09. We got letters stating that we would be laid for a period of 2-weeks.

Can I claim unemployment benefit (all americans and naturalized citizen employees are) when it's a temporary lay off?

Thanks,

PH2

unemployment benefits are only for GC holders and american citizens. If you are on H1 or EAD, then you cannot claim unemployment benefit.

OP is being laid off temporarily for 2 weeks. It is like a (forced unpaid) vacation for 2 weeks.

I am not sure if he can claim UI benefits for just 2 weeks.

UI benefits while on EAD status??

Wrong. If he has an EAD, he can claim UI benefits.

Could you please explain more on this? on EAD status, if you claim UI benefits USCIS will raise the questions about future employment right?

=>I am in impression that USCIS may reject I-485 if any one claim UI benefits while on EAD status.

Please give me more insight on this.
