U.S citizen sponsoring his brother over 21

I have being in the united States for some years going to college, my older brother, who is a pharmacist and has being in the States for over 35years is willing to file for me but he doesn"t know what to claim me as. He has technically being my father after our dad deceased some couple of years back . My older brother is the one paying for my tuition and fees, i do not have any other relatives back home that is going to take care of me. I would like to know if he can file for me and what can he claim me as?he has some documents that he has being taking care of me and my father has it in his "will" before he died that my brother should take full responsibilities for me and my twin brother. Please I need your help and testimonies. Thanks
 
Thanks for your reply.. what are the paper work does he need to fill out and which paper work do i need to complete too?Do you have any idea how long it would take me to get my green card if we both have all the paper work filled out and turned for processing?

What is your current immigration status? I'm guessing you don't have a student visa, as it would be very difficult to obtain one under your circumstances. Unless you had it before your father passed away.
 
I am still on F-1, I have never being out of status and I am currently in a university for over 3 years now. I was just wondering if there are other ways my brother could file for me without waiting that long period of years (10) in other to be eligible for status adjustment.
 
There is no way to jump the line in a particular category. You are no more important that all of the others - many siblings of posters to this forum - already waiting. You will have to be patient or find an employer to sponsor you in the employment based category - also a long wait.

If you cannot maintain legal status on the basis of your own credentials, you must go to your home since illegal presence is not forgiven for siblings.

There is no way to escape that 10-year waiting period for sibling sponsorship, unless they change the laws. But there are other routes to a green card that are faster (if you and your circumstances qualify), such as marriage or employment.

If your brother files for you, make sure he selects a US consulate in your country for question 22 of the I-130, as it is unlikely that you will be inside the US legally 10 years from now. Because if adjustment of status is selected and you aren't in the US when the time comes, there will be a delay and fees to transfer the case to a consulate later.
 
Considering the long list of pending applicants, you can be very well assured of the delay if u apply now. Even if you land a plum job and get your employer to sponsor you, it is not going to shorten your processing time.Marriage is also another option to get your status faster. Choose the option which suits you better. Complete all the needed procedures snd submit an error free application( Errors will result in further delay) Good Luck!!
