Typical situation.please help

Hi Gurus,
I am on H1B and my wife on H4 and both of us are having EADs. Now we applied for 7th year ext and after we filed my wife got a job using EAD. Can she work now?.

If so, what will happen after we get our H1B/H4 ext approved. Is this illegal?. please help

Please post the answer to the question asked and not be a judge whether this has been answered before or not. Unlike many, some do not have the time to keep searching threads all over the site. Atleast have the courtsy to point to the correct thred if not anything else...

I know you have been very active in answering many questions, and if you had the time to type the reply, could you not have typed the answer to the question ?

BTW, I myself do not have an answer, but was loking for an answer as this is my situation too. But ginnu's 'answer' has been not helpful at all to me aswell...

--- YOU applied for 7th year H1B status not “we” you might have sent your wife I-539 form for her H4 extension with your H1 extension. If your wife has valid EAD she can work on EAD till validity date of EAD Once she uses EAD she will have to use AP for re-entry to US. Also AP for her if she wants to go out of US in near future as AP is taking 4-5 months in service centers to get it approved.
If so, what will happen after we get our H1B/H4 ext approved. Is this illegal?. please help
---- Once you get your 7th year H1b approval extension you will be on H1 status if YOU don’t use EAD, spouse will be on AOS pending and NOT on H4 status as she used EAD. If spouse used EAD no effect on your H1B status you can be still on H1B status. If you the primary applicant or H1B holder use EAD then also the spouse is not on H4 status as H4 is linked to H1b. she will be on AOS pending status if uses EAD and nothing illegal in it.

** if Ginnu answer has not been helpful you have your lawyer pay him and get the answer. This kind of language should not be posted here in this newsgroup and nobody should be accused if you don’t get ans to your question. It is free service from and we share the info and get valuable info for different concerns. To accuse anybody for not answering your question is not correct. Try to be polite to get answer and don’t shout and accuse if you are more frustrated then vent your frustration some where else.

Wow guys, what loyalty to ginnu !!

I am not going to delete my post and I feel there is nothing wrong in the post. This is America, ain't it, and everyone has the right to air their opinion !!

The point I was trying to make (which seems to have not come across at all), is that when ppl ask a question, it helps others also, who are in a similar situation. I am not expecting answers from a particular person, but if someone knows the answer, even if they have come across the same question a gazillion times (because different ppl will have the same situation..and same problems; as we are all in the same boat after all). So if whoever knows the answer, takes some time to type his response that helps everyone. If you do not or are not able to reply, then just read and move on, why give a reponse that servers no purpose rather than to make the person asking the question feel like a fool ?

I know ginnu has been a good expert, and I have benefited also from his replies, but the bottomline is, this is a forum which helps all, and questions are bound to be repeated........whats the big deal ??

BTW saathia, whats your age, you sound like a 5 year old telling his mom and dad .....don't answer his questions..:) !!!! And for your information I use this forum not only to ask but also to GIVE answers.

You can ALWAYS move back to where you came from. No one is stopping you -- especially not BCIS. Just book the next flight home. Or row. Like it or not, residing here is a privilege and not a right, so wait patiently like everyone else. And be civil about it.
 
You should drop that back to 2-0 because I do not support anyone. Ginnu's reply was succinct and directed to the original post, though he could have made it clearer. You, on the other hand, waded in with a chip on both shoulders and then made it personal. Your point is a valid one but you could have been more civil. You could have simply ignored Saathia.
