two non-citizens marriage?

first of all, hi everyone, I'm a new member on this forum.

here is my situation:
I'm curently in usa on J1 visa, and section E212 doesn't apply on me. I am originaly from bosnia, but i don't think that really matters in this case :)
during my stay here I met a girl from russia, and now we are in very serious relationship. unfortunately, our relationship has an expiry date which ends when our visas expires! i can't speak russian and she obviously can't speak bosnian, hence we don't have any future in our home countries together!
only way for us to stay together is to stay here in usa, and now we're trying to find a studying or work visas are not an option as we don't have money for that or any serious job offers. so far, only option we have found is a marriage for usa citizens. it is pretty obvious that is very complicated situation, and we would like to live together, not with some formal partners.

now finally my question: is there any way we could be allowed to stay in usa on OUR marriage basis? can we get married and try to prove that our relationship can exist only in usa, and maybe ask for asylum on that basis?
I think i heard somewhere that having a baby could be an option, but we don't really want to have a baby, as we are still young and don't have capabillity for raising kids.

I'm pretty sure that we are not the only persons in such a situation, and I hope someone can help us with advice.

Only way out is one of you to have dependent visa, but it also has expiration. After expiration of current visa status(you are not subject to 2 year HRR, right ?), you need to go for dual intent visa such as H or L to apply for GC, otherwise it's pretty difficult to get GC down the road.

And one more chance is applying for DV program if congress did not terminate it this year. It's lottery, chance to win is very slim, though.

Baby born in the US will be US citizen, but baby can not support parent's PR until they turn to 21.
And asylum is applicable to those who has life threatening situation in their home country. So, it does not work.

Immigrating to the US in your situation is not easy.. You may try Canada(I'm not sure how friendly canadian immigration is to you, though).

the chances are not promissing it seems. I am not subject to 2 year HRR, neither she is. I'm not sure what do you mean with dependant visa, but as I understand L and H visa is employment based category, and it's pretty hard to find a company willing to sponsor any of us.

any other ideas?

I just saw your edit about canada. canada is not bad option, but we are already used to life here, and have some friends in chicago where we curently live. anyway, everything is better then going back home in such a situation :)

I already play dv lottery, so I hope to receive letter from them these months :) but I'm aware chances are slim.

I don't want to sound negative...but immigration everywhere is by relative, employment, in some countries goverment considerations applies (like you are an Einstein) and like in Canada that they have "provinces nominees" of course if you want to live in an igloo :D , the DV lottery as well, except asylees or another humanitarian reasons.

I don't know you... but when you came to study did you consider that you was going back unless you find an employer to apply for you? :rolleyes: That got marry here as a foreigner with another foreigner is the same if you got marry everywhere else and neither you or your spouse are nationals of the country you decided to live.

I never planned to stay in usa before, but some things one just can't predict! that's a feeling when you find your soulmate, and realize that you have no future anywhere else!
i'm trying to learn russian, but i'm aware that i'll never be fluent enough to live in russia as it is very hard language, although very similar to bosnian.
time is tickin' away, and we'll have to find some way out of this, that's why i'm asking for advices here.
 
I feel very bad about your situation My friend who was doing his MBA was in love with this Korean girl in his calss both could not find a sponsor and had to go back... and are seperated now..... immigration laws suck.. :( .. where as people who just jump the fence can get to stay... :mad:

I know some firms that will sponsor you if you take a big pay cut and work for them.. so try to find someone like this in Chicago I bet they exist.. you dont have to work for IBM or GE to get a GC via work.. try very small firms even small family retails can sponsor...

It is not necessary to be big company to sponser H1 and GC, but that company must have ability to pay prevailing wage. If they could not pay prevailing wage, I-140 will be denied as well as I485.

I didn't want to suggest Canada when I first saw your post cause I didn't want you to have the wrong impression that I want to send you away and keep the whole US for myself, like other smart ones here may believe :rolleyes:

But since you may be somehow opened to this option, as far as I remember, Canada is a pretty easy option, they have that "score thing", and is very easy to get admitted, a few years ago when my GC never arrived I was thinking about that option, and if it wasn't for the sponsor/ job offer I could have the perfect score.

I know, Canada is not U.S., no other country is U.S. for that matter, but, like you've said...is better than going back or...learning Russian and live in Russia ;)

we still have like 15 months remaining, and hopefully we'll find out something in the meantime.

It's hard to find a company willing to sponsor someone, but it is worth to try out.

if nothing else, we'll probably try with fictive marriage, as that is the most common way for people who have noone to sponsor them.

does any of you knows how this forecoming immigration law could make things worse for us?

I didn 't take that part seriously in your first post. If that's your back-up plan then you need to start learing Russian right away.

If CIS found it , you'll NEVER be able to come into the US and you deserve it.

Do you realize that by doing that you commit a felony and if get caught you will be arrested on site, deported and banned from entering this country forever? This forum is a place to help people with their REAL marriage AOS applications and not for those who try to commit fraud. :mad:
