Two I-94

Hello All,
I was granted an H1-B in 2002 which came along with a I-94 attached. That I-94 expires in 2005. I got an new I-94 last month when I entered US. This I-94 expires in March 2004 (next mont) as my passport was valid till March 2004. I got a new passport. Now, which I-94 should I be using. Should I be using the old I-94 that came with my H1 and expires 2005 or the new one that expires next month. If the most recent I-94 is the valid one, I need to apply for an extension.

I visited the local office here and they say that my original I-94 should be fine. I called BCIS and the immigration officer says that I am fine as the old I-94 would be valid till 2005. Are they right?

Should I be doing anything? Please advise.
 
the newest I-94 replaces all previous I-94's . In other words when a new I-94 is issued all previous I-94's become invalid. This may not immediately pose a problem but can be a problem when returning to the country after an international trip. Many immigration officers are not aware of this I-94 confusion, etc. the right person will be to talk to a deferred inspections officer. Normally the deffered inspections office is located at the customs and Border patrol office(CBP). btw the person at the airport who issues the I-94 is not an immigration officer. those are CBP officers. not suprisingly immigration officers do not know much about I-94.
 
Thanks for your reply. What do I need to do to correct this situation? Do I do out of status after next month when my newest I-94 expires?

I would be traveling overseas so I would like to be enter US again. I dont want to get into illegal status either.

I would appreciate if I could rectify this situation.

locate the deferred inspections office nearest to your city / town and visit them and ask for a correction. You will most probably need your passport I-94 and I-797 approval etc. if deffered inspections does not extend the I-94 the easiest solution will be to go out of the country and re-enter if you have a valid visa to re-enter. Also when you re-enter check at the post that they give you a correct I-94 date.
 
Guys, I am confused, are you not supposed to turn in all your I-94's when you exit the country?? I too have 2 now, one expired, and the other which came with my extention papers. I believe I should turn over both my I-94's when I leave the country - or am I missing somthing here..
